County to hold three joint virtual work sessions to review draft Chapter 16 Development Code

Los Alamos County Community Development Department (CDD) and its consultant, Dekker/Perich/Sabatini (DPS) will present the final draft of the Chapter 16 Development Code to the Planning and Zoning Commission and County Council in three joint virtual work sessions October 12, 13, and 14 from 1 to 5 p.m. Both the October 11 County Council regular meeting and the October 12 Planning and Zoning Commission meeting are cancelled.

Did You Know?

For the first quarter of 2022 (January - March), there were 111 Courtesy Letters issued, informing property owners of potential property maintenance code violations. Of these, 84 stemmed from observations by the Compliance Officer, and 36 were in response to a complaint received. The most often cited issue was for outdoor storage of materials (Sections 18-43 and 18-44 of the Municipal Code). There were an additional nine complaints received that the Compliance Officer determined were unfounded. Only four out of the 111 cases subsequently resulted in a formal Notice of Violation, which happens when the property owner does not remedy the issue identified within a set timeframe or work with the Compliance Officer to structure a timeline to correct the situation.

Bulk waste collection is available from the County for a $25 fee. If you have large items that don’t fit in the trash bin or if you don’t have a pick-up to haul materials to the EcoStation, you can schedule a bulk trash pickup. Appliances, bicycles, furniture, large tree limbs or stumps, and mattresses are all fair game. It is important to follow the program’s guidelines to ensure that inappropriate materials are not directed to a landfill and that public safety is maintained while materials are stationed curbside for pickup. Details of the program and what CANNOT be put in the pickup are available at https://www.losalamosnm.us/government/departments/public_works/environmental_services_division/services. Register for a pickup by calling the Eco Station at 662-8163 or sending an email to [email protected].

Code Compliance Survey Open To Everyone

Los Alamos community members are encouraged to take a survey currently underway by the Los Alamos County Community Development Department (CDD) and its consultant DPS. The survey is specifically seeking input on the County’s Chapter 18 Nuisance Code. Open until December 27, individuals can access the online survey by visiting the Chapter 18 Nuisance Code Update webpage (https://www.lacchp18update.org/). Did you know that if you get a “Friendly Letter” from the County but don't have the ability to actually get out there and fix the problem, CDAB has put together a list of organizations willing to help for free! Maybe you had surgery and can't mow your own grass for a while. Maybe you are getting older and don't feel comfortable getting on a ladder. There are lots of reasons and we understand. Don't be afraid to reach out if you need help!

Did you know that it is a violation of County Code to leave items on the curb for free? Whether it’s an old desk or a gold-plated coffee table, it’s not legal. So, if this was your house, you might get a “Friendly Letter” from CDD telling you to dispose of the items left on the curb.

Unfortunately, the County staff have no real way of knowing if you just set it out yesterday or if it has been there for weeks. So, give your items to a local shop, or use Freecycle, the buy-nothing Facebook group, or the reuse center at the Los Alamos Eco Station for your unwanted treasures.

Spot the violation! Round two! Let’s see how you do!

What is wrong with this photo? Why might this homeowner get a “Friendly Letter” from CDD? If you guessed the weeds over 18 inches tall, give yourself a pat on the back. You are right!

The Los Alamos County Code requires we keep our grass or weeds cut below 18 inches. So, get out that lawnmower, weed-eater, tractor, or scythe, cause this yard is in serious need of a haircut! Tall weeds and grass create hiding places for vermin, are a fire hazard, and appear unsightly!

Remember, if you have any input about the Code, now is the time to make your voice heard. Email CDAB at [email protected]. Don't take it out on the staff…CDD doesn't write the code, they just enforce it.

Let’s play a game called “Spot the Violation!”

Look at this photo closely to see if you can spot the County Code violation. Can you see it? If you said “The car is obstructing the right of way on the sidewalk”, you are correct!

In Los Alamos, property owners are responsible for maintaining the right of way for pedestrians to walk freely on the sidewalks adjacent to our homes. Whether it's cars, tall weeds and plants, or tree limbs blocking the sidewalk, the property owner needs to take care of it. Let’s all do our part to keep walkers safe, especially during the school year.

Statistics make the world go round! From January to March of 2021, 45 property maintenance issues were acted on by CDD. Of these, 44 were residential and one was commercial.

Total, there were 27 for sanitation /trash /debris, 12 for improper outdoor storage, 12 for improper homeowner responsibility, two for excessive or overgrown weeds, one for having an inoperable vehicle in a front yard (without an opaque cover on it), and one for external protective treatment (paint or stucco needing attention in some way). Of these, 27 were Code Officer initiated, 18 were complaint driven. A further breakdown shows that seven were anonymous complaints.
