Compared to me the Courts didn't make Ball & Pinsky jump through every procedural and technical hurdle and exhaust remedies... But I have actual ongoing Article 3 injuries and am trying to move forward.

I KNOW the historical EMS-24-0007 NYSDOH - New York State Health Department 134 count conviction & 's fight seems counterintuitive... but read Hon. Ken Kelly words again and again... the WHY is present & the advice still valid. https://decisions.courts.state.ny.us/ad3/Decisions/2026/CV-24-1117.CV-25-0151.pdf 3rd Appellate Division has now committed US Constitution Section 1 violations by allowing Ball v DOH CV-25-0810 through, argued by FLREMSC Attorney Brad Pinsky, while dismissing Andrew DeWolf CV-24-1117/CV-25-0151 by ordering Andrew has to exhaust administrative remedy under CPLR Section 7801(1). This is being addressed, stay tuned. The difference between the cases is that DeWolf is pro se self represented and an and Ball v DOH is represented by an Attorney but is NOT a whistleblower. It appears that Third Appellate Division let New York State Attorney General write thier briefs for them, ONLY considered what had to say, and literally ignored all fo the pro se litigant facts and laws even those ADMITTED by Respondents, which of course is UNDER OBJECTION.

- The DeWolf v Wayne County et al whistleblower complaints officially began May 3, 2018 ... DeWolf wasn't fired until July 2, 2021 .... and NYS DOH didn't convict DeWolf until August 8, 2024 in EMS-24-007. So two (2) Supreme Court cases related wound through the Supreme Courts and are NOW finally, as of today, APPEALED to the Third Appellate in Albany with a FINAL decision and final notice of appeal paid for, served, and filed. Next comes a ton of Appellate work to get a final consolidated record, write briefs, etc. A ton of $$$ and a ton of work ahead... but this is a GREAT milestone!!!! JUSTICE is hopefully coming! Honestly relieved ... Once a final record is ordered/agreed at 3rd and perfected, I'll share everything online because as far as I know, the gag orders are off once it's all appealed. Now, government can NO LONGER muzzle me and silence me at all and it's time justice is obtained.

On another aside update - Ball v DOH CV-25-0810 - a related case to mine, was just argued about 10 days ago at 3rd as well and will help my case on the way up! That's being argued by Attorney Brad Pinsky who worked against my complaints as an attorney for Finger Lakes REMAC/REMSCO and helped suppress them and cover them up via those roles... now he's representing Justin Ball in a historic 7th Amendment case on the other side...

One honest person can expose an entire rotten structure.
It doesn't matter if everyone else is complicit.
It doesn't matter if the system protects itself.
It doesn't matter if telling the truth costs you everything.
One voice, speaking truth, can shatter silence.
Serpico lost his career.
He lost his hearing.
He lost his health.
He nearly lost his life.
He was shot, abandoned, and left to die by the very people who had sworn to protect each other.

IF Codes are for safety, WHY do they cover literally every aspect of your life? Government taxes you and can take your property for unpaid taxes ... but it also can control EVERY aspect of what you do with the property and require permissions, fees, permits, and fines as a result.

Matter of Justin Ball vs NYS DOH, CV-25-0810, incorporating the to the States via the , was just argued in Oral Arguments at Third Appellate on February 10, 2026. https://cmi.nycourts.gov/vod/CourtSession/ad3/CV-25-0810 (I missed it :( ) This case is after mine in which I'm the first to ever argue to NYS DOH for the right to a jury trial, but FLREMSC/Dr. Syrett's lawyer Brad Pinsky is the 1st to WIN! So now this moves forward in history as well. I applied for and was denied consolidation with Ball v DOH.
