For Municipal Court cases, please contact the municipality the case is out of or retain private counsel. Please be advised; when someone is charged with a crime, normally the court system can be a lengthy process. A case is not handled overnight. Cases can last for months and sometimes, even years. Therefore, patience is your only op
tion. Due to our caseload, it is the client's responsibility to contact our office and keep up with court dates. ***To obtain the services of the Public Defender, one must pay a non-refundable $40 application fee at the Clerk of Court's Office. This office is located at 100 W Court Street in Marion. It is the brick building behind the big, historical Courthouse on Main Street in Marion. Payments must be made in Room #101. Only payments in the form of cash, money orders or cashier’s check are accepted. Pursuant to §17-3-30(b), a $40 application fee must be collected by every person who executes an affidavit that he/she is financially unable to employ counsel. Failure to make payment can result in a Circuit Court Judge adding the unpaid fee to court-ordered court costs at the disposition of your case. Magistrate & Juvenile Clients:
***To obtain the services of the Public Defender, please call our office to make an appointment for the screening for our services. Please bring the following to our office within 10 business days of your arrest date or served date or if ticketed 10 business days of your first court date:
• Warrant(s)/Ticket(s)
• Bond paperwork
• Proof of Income (Last 2 paycheck stubs, Disability paperwork, Food Stamp paperwork, Unemployment, etc.)
• If unemployed and do not receive unemployment please bring a notarized statement of who pays your bills.
**You WILL NOT be represented by the Public Defender’s Office until you pay the $40 fee. **
For those that have loved ones held in the Marion County Detention Center or SCDC:
Please note, inmates can call our office for FREE from Marion County Detention Center. We do not accept three-way calls as it interferes with attorney-client privileges. The best way for inmates housed in South Carolina Department of Corrections to contact our office is through legal mail. Resources:
