E-Bike or bicycle? Motorized Pedacycle or Motor Scooter? We have had some questions lately about what types of 2-wheeled conveyances can be legally operated on a public roadway, so we thought it best to clarify what the law says.
BICYCLE: is a pedacycle that is moved soley by human-powered pedals. Bicycle riders under the age of 12 must wear a helmet, and lighting must be used when operating between sunset and sunrise. You do not need a drivers license to operate a bicycle, but you CAN be arrested for DUI on a bicycle.
E-Bike: is a pedacycle with electric assist, which weighs less than 100 pounds, has operable pedals, a motor rated at not more than 750-watts, and is not capable of going fast than 20mph on a level surface when powered by the motor only. E-bike operators do not need to have a driver's license but must be at least 16 years-old and can be arrested for DUI on an e-bike.
Motorized Pedacycle: is a pedacycle with operable pedals and either a gas motor that is less than 1.5 brake horsepower with an automatic transmission, or an electric motor powered by an electric battery; and is designed to travel no more than 25mph. Motorized pedacycle operators must be at least 16 years-old, must have a class c driver's license, and can be arrested for DUI. The motorized pedacycle must also be registered and have vehicle insurance.
Motor Scooter: is a motor-driven cycle with a motor size not to exceed 5 brake horsepower. Motor scooter operators must be at least 16 years-old, must have a valid license (class M if the motor is more than 50cc, class C is the motor is less than 50cc), and can be arrested for DUI. The motor scooter must also be registered and have vehicle insurance.
Electric Scooter: can only be operated on private property, cannot be legally operated on a public roadway.
