- Late on February 3, responding to a second motion by the National Council of Nonprofits and other organizations, a federal judge issued a second temporary restraining order (TRO) blocking the White House from “implementing, giving effect to, or reinstating under a different name” the directives in the original OMB funding freeze memo with respect to the disbursement of Federal funds under all open awards. The judge further directed OMB to communicate to all federal agencies to which the original OMB memo was addressed, to inform them about the ruling and to “release any disbursements of open awards that were paused as a result of” that memo. This TRO, like the one before it, applies only to existing grant programs and not new ones.

In a separate case filed by New Jersey + 21 other states and the District of Columbia, on January 31 a judge issued a temporary restraining order blocking the freeze of funding for the plaintiff states/jurisdictions.

BREAKING NEWS - Granting a motion filed on behalf of the National Council of Nonprofits and others, a federal judge in the District of Columbia has temporarily blocked the White House Office of Management and Budget’s freeze on federal agency grants and loans. Yesterday, November 21, by a vote of 219-184, the U.S. House of Representatives passed harmful legislation that would empower the U.S. Treasury Secretary to unilaterally deem nonprofits as terrorist-supporting organizations and revoke their tax exemptions with little due process. The bill now moves to the U.S. Senate.

1) Urge Senators to oppose HR9495 if it comes up for a vote there.
2) Be sure to THANK members of the House of Representatives who voted NO. Due to your advocacy, several members changed their votes. Your voice makes a difference!

URGENT ALERT - Call your Congressional Representative TODAY and tell them to OPPOSE H.R. 9495. This bill is extremely harmful to nonprofits.

The U.S. House of Representatives is preparing to reconsider H.R. 9495, legislation that would empower the U.S. Treasury Secretary to unilaterally deem nonprofits as terrorist-supporting organizations and revoke their tax exemptions with little due process. This bill failed to pass the House on November 12, but the House is planning to take it up again starting November 18.

H.R. 9495, the "Stop Terror-Financing and Tax Penalties on American Hostages Act," purports to stop bad actors from using nonprofit organizations to fund terrorism, as is already prohibited under current law. It also includes some laudable provisions to extend tax deadlines for those unlawfully or wrongfully detained or held hostage abroad.

But H.R. 9495 goes much, much farther, building on provisions in previous legislation, H.R. 6408, to empower the Secretary of Treasury to designate 501(c) organizations as “terrorist supporting organizations” and revoke their tax-exempt status with minimal due process. It would allow the Secretary to bring such accusations without disclosing the evidence behind them and would place the burden of proof on the organization to disprove the allegations. The potential for overreach, subjective application, and abuse of this authority is enormous, and the consequences for organizations and the people they serve cannot be overstated.

ACTION NEEDED:
Call your Congressional Representative TODAY and urge them to vote NO on H.R. 9495 when it comes up again for a vote. You can find contact information for your Member of Congress below, and links to additional articles in the comments.

During this period, registered voters can cast their ballot in person at designated early voting locations in their county of residence.
