Certified Copies of Birth Records for Individuals Who Have Been Adopted
The Burke County Register of Deeds office is pleased to announce the passing of Senate Bill 248 that allows the local Register of Deeds office to issue certified copies of birth records for individuals who have been adopted. While this bill went into effect on January 1, 2026, we did not put out a press release announcing the new law due to anticipated difficulties in implementing the change. As anticipated, the North Carolina Office of Vital Records’ Database Application for Vital Events (NCDAVE), an electronic recording system, was not equipped to handle the legislatively mandated change. In addition, the North Carolina Office of Vital Records did not create an interim process to issue these records until January 6, 2026, causing another delay in our office being able to issue a certified copy of an adoption birth record.
The interim process involves manually sending records to the Register of Deeds office upon request. For individuals that were born in 1971 and later, the North Carolina Office of Vital Records is to send the record within 30 minutes. For individuals that were born prior to 1971, the North Carolina Office of Vital Records has up to 2 business days to send the record due to the records not being digitized.
It is anticipated that the Database Application for Vital Events (NCDAVE) will be updated for the local Register of Deeds offices to be able to issue certified copies of adoption records sometime in February, 2026.
Since January 6, 2026, we have been able to successfully issue nine certified copies of adoption records. We are excited to be able to provide this service to the citizens of Burke County and will be glad when all of the “bugs” have been worked out of the electronic system and there will be a faster turnaround time for these records. Please note that at this time, Register of Deeds offices can only issue certified copies of birth records for individuals who have been adopted in the county to which they were born. It is anticipated that in the future, local Register of Deeds offices will be able to issue certified copies of birth records for individuals who have been adopted and who were born in another North Carolina County.
