The North Dakota Alcoholic Beverage Code is outlined in Title 5 of the ND Century Code. "Beer Gardens" are considered an extension of a licensed establishment. With the Beer Garden set up currently in town for the All Schools Reunion, please be respectful of other attendees, the city of New England and all of the establishments by following the laws regarding them. Namely, stay within the designated area with your alcohol. Tents and flagged off areas have been provided by the City for you.

REGARDING DISCHARGE OF FIREWORKS:
We have received several complaints of fireworks being shot off AFTER the allowed timeframe. These are situations where everyone knows who's doing it, but no one reports it. Just know, we are following up and have issued Citations.

The MOTT CITY ORDINANCE reads as follows:
"No person shall discharge, or otherwise set off any consumer fireworks described by this Article within the City at any time other than the period of the 27th day of June through the 5th day of July and the period of December 31st through the following January 1st, subject to the following time restrictions:

1. Fireworks may only be discharged or otherwise set off from 10:00 A.M. to 10:00 P.M. for the
period of June twenty-seventh through July third.
2. Fireworks may only be discharged or otherwise set off from 10:00 A.M. to midnight of each
day for the period of July fourth through July fifth.
3. Fireworks may only be discharged or otherwise set off from 10:00 A.M. on December thirty-first
to 1:00 A.M. on January first.
4. In the event of a county wide burn ban, the use of fireworks is prohibited."

NEW ENGLAND CITY ORDINANCE re: fireworks:

“Fourth of July” explosives whatsoever within the City limits are limited to the hours of 8:00 am to 10:00 pm on June 27th through July 2nd and 8:00 am to 1:00 am on July 3rd through July 5th and 11:00 pm December 31st to 1:00 am January 1st.

Furthermore, the use, firing, or discharging of any fire work defined in Subsection 5.0104, or of any such “Fourth of July” explosives are prohibited whenever a “burn ban (restriction)” is issued by the City of New England or Hettinger County and is considered a Class B Misdemeanor.

5.0201 Penalty-Violation of Fi****ms, Fireworks, and Explosives Chapter

Any person violating the provisions of this chapter shall be guilty of an infraction and upon conviction thereof, shall be subject to a fine of not less than fifty dollars ($50) nor more than five hundred dollars ($500). Each occurrence of such violation shall be deemed a separate offense. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions."

CITY OF REGENT ORDINANCE
4.0505 FIREWORKS - DISCHARGING OF, SALE OF
(Regent falls under the old city ordinance regarding the discharge of Fireworks as they have not adopted the new ordinance as of this writing)
"The sale, use firing or discharging of any rocket, firecracker, torpedoes, roman candles or of any such "Fourth of July" explosives whatsoever, or fireworks within the city limits is expressly prohibited at any time whatsoever, except as provided by state statute."

To note, the County Burn Restrictions are tied to the DAILY Fire Danger Index. So, if for that day, Hettinger County is in HIGH, VERY HIGH, EXTREME or RED FLAG WARNING, the ignition of fireworks is Not Allowed. This changes EVERY DAY and needs to be checked beforehand. https://ndresponse.gov/burn-restrictions-fire-danger-maps

Pronghorn Survey Begins

The North Dakota Game and Fish Department’s annual aerial pronghorn survey will begin June 28 and is scheduled to be completed within two weeks.

During the survey period, small airplanes will sometimes fly low over parts of western North Dakota.

The survey determines pronghorn abundance, herd demographics and fawn production. This data is used to set the number of licenses for the fall hunting season.
