New Kent County, Virginia is at the Center of the East Coast, within 750 miles of over 55% of the nation’s population and nearly 60% of its personal income and consumer expenditures. Please note that comments submitted to County social media platforms may be public records subject to the Virginia Freedom of Information Act and applicable records-retention requirements. Before a comment is hidden,
deleted, or otherwise removed under this policy, the County will take reasonable steps to preserve the comment and related information as required by applicable public-records and records-retention law. As a government entity, we may not and will not hide, delete, or otherwise censor comments based on viewpoint, disagreement with the County, or criticism of County officials or employees. The County may remove or hide comments only when the restriction is reasonable in light of the limited-public-forum purpose of the page and is applied without regard to the commenter’s viewpoint. After preserving the record as described above, the County may remove comments that contain:
- Obscene material, as defined by applicable law, or profanity that is not relevant to the topic of the County post and materially disrupts the limited-public-forum purpose of the page
- True threats, incitement to imminent lawless action, or targeted harassment that is unlawful or that materially interferes with the ability of others to use the forum for its intended purpose
- Speech that unlawfully discriminates against, harasses, or threatens a person or group based on a protected classification, or that otherwise falls outside First Amendment protection
- Solicitation, promotion, or facilitation of illegal activity or conduct that violates federal, state, or local law
- Personal identifying, confidential, or sensitive information, including Social Security numbers, financial account information, medical information, home addresses, personal telephone numbers, or information concerning minors, when disclosure is not authorized by law
- Content that appears to violate copyright, trademark, or other intellectual-property rights
- Spam, repetitive posts, automated content, malicious links, malware, or content that is unrelated to the topic of the County post
- Commercial solicitations or advertisements; fundraising appeals; or campaign-related advocacy for or against a candidate, party, ballot measure, or political committee when unrelated to the topic of the County post. After the County has preserved the record as described above, comments that violate this policy may be hidden, deleted, or otherwise removed in a viewpoint-neutral manner. Continued or egregious violations of this policy, including violations of the applicable platform’s terms of service, may result in the user being reported to the platform or restricted from further participation to the extent permitted by law and platform rules. Where a comment contains a true threat, incitement, evidence of illegal conduct, or other circumstances warranting referral, administrators may report the matter to law enforcement.
