The feds must continue to provide gender-affirming care to transgender people in federal prisons, for now, the U.S. Supreme Court said in a rare ruling for this court.

The various ways that officials have tried to ban medical and social transition care in federal prisons — including attempts to ship more than a dozen trans women from women’s prisons to men’s prisons — have all been challenged legally.

Lower courts have blocked most of the new federal policies. These blocks, called “preliminary injunctions,” are temporary while the cases proceed.

For its policy announced in February, the Trump administration appealed the preliminary injunction. The Supreme Court declined to overturn that on Oct. 21, meaning the federal prison system can’t currently ban gender-affirming care.

This case will still have months of briefs and arguments, and we’ll keep a close eye on it.

In Cleveland, county jail officials updated an employee handbook in January to require that corrections officers perform CPR in medical emergencies. But they haven’t told most of them yet.⁠
⁠
The update came as The Marshall Project - Cleveland reported on a series of 20 deaths inside the Cuyahoga County Jail in recent years, at least half of which involved inadequate medical care or failure to promptly administer CPR.⁠

We are suing ICE and U.S. Customs and Border Protection to force the agencies to publicly disclose all the people in their custody.

When local law enforcement makes an arrest, that person’s identity, criminal charges, and detention location are made public in nearly every jurisdiction in the United States. But ICE rarely publicly reveals the identity of people it detains.

“We are seeking the same transparency and access to information that have existed within the criminal justice system for centuries. Detainees’ family members and those seeking to defend their rights deserve to know at least where they are being held,” Jennifer Peter, The Marshall Project’s editor-in-chief, said. “To withhold that information in the name of privacy does not serve the best interest of the people whose privacy the government alleges to protect. It makes it far more difficult for their loved ones and attorneys to help them — and for organizations like The Marshall Project to shine a light on what’s truly happening within immigration camps and who’s being held there.”

ICE arrested more than twice as many children between this January and July as it did in the same period in 2025. Many were traumatically torn away from friends, family, and homes, lawyers said.⁠

Many of the children ended up at an immigrant camp in Dilley, Texas. But others have now been held in places where their families and lawyers couldn’t find them.⁠
⁠
Between January 2025 and August 2026, ICE arrested more than 8,500 children under Trump. ICE also detained more than 8,750 kids in that same period. The two numbers don’t match exactly because children can come into detention via various methods, like being apprehended by Border Patrol, and because children can be arrested without being detained.⁠

Under the Trump administration, ICE has held some children and families for several days in locations that lawyers say are “black boxes,” where families and lawyers cannot find them.

Families described constant surveillance, limited access to food, and threats of separation if they told anyone where they were being kept.

“It’s unsurprising we are seeing this number of hunger strikes this year,” said Setareh Ghandehari, advocacy director at Detention Watch Network. The Trump administration “wants to keep as many people in detention as long as possible, or deport them — that is the goal.”

Alireza Fadaeieshkiki sought asylum at the U.S.-Mexico border last year. The Iranian government had arrested, severely beaten and persecuted him for serving as a Christian pastor and hosting prayer meetings, according to Fadaeieshkiki’s attorney and a sworn declaration shared with us. These are activities banned by the theocratic Islamic regime with which the U.S. is at war.

“I have [a] problem with torture in Iran,” Fadaeieshkiki told us on Oct. 2. “Here, I may lose [my] life.” He said ICE placed him in solitary confinement for going on a hunger strike with others at a Texas camp.
