KPCW reached out to the Sweeney family and asked if there was indeed a reset button.

While Pat Sweeney asked KPCW not to use his voice, he did go on the record saying as the owners of the property, they’ve all agreed to stay out of the discussion, that it’s a decision for the community to make.

Should the bond be voted down, they will move forward with the 90 percent density design as agreed on with the city. However, should the community approve the bond, they will graciously accept the money.

Bottom line, there is no reset button because they have no interest in starting over.

A few points on Eminent Domain and the UT Ombudsman’s office:

-PCMC can not compel the landowner to use the UT Ombudsman’s office.
-The landowner has to initiate the UT Ombudsman’s office to mediate the value of the taking.
-The Treasure landowner clearly would not initiate mediation with the UT Ombudsman’s office to get a lower value.
-The Sweeney’s would only initiate mediation to get a higher value.
-They would likely start at $90.9M which was their request back in 2011. http://archive.sltrib.com/article.php?id=53163878&itype=CMSID
-The UT Ombudsman’s office functions to get fair market value (+ penalties + interest) for the landowner who is under an Eminent Domain taking by a government entity.
-The UT Ombudsman’s office is not there for the government to take property and then hammer the private landowner to accept less money
-Remember there is a willing buyer and seller at $64M, a mediation will be for more, not less.
-Then the citizens will pay through a tax, no vote, pay whatever the court decides: right away + 8% interest + lawyers fees + penalties right now, not over 15 years.

Some easy math to let people know the Treasure Hill price tag is by no means too high.

The $64 million purchase price is based on comparable sales. The developer is entitled to over 200 Old Town lots. Such lots are currently selling for $1 million or more. Sales of resort development property in Deer Valley reflect an even higher price point.

Letters: Treasure development would have ‘significant impact’ on all of Park City

As a Park Meadows resident, I am not in the same neighborhood as the potential Treasure project but I think it will have a significant impact on everyone in Park City, locals, tourists and businesses. Because of this, I am strongly in favor of the bond.

A no vote on this bond will result in massive and intense construction directly above the town lift base, blasting and digging almost a million cubic yards of material. Add dust, noise, cranes, thousands of concrete trucks, and tremendous amounts of steel to complete buildings as high as 12 stories. Worst case, imagine what happens if construction gets partially completed when the next big recession hits. How long will we have to look at that huge mess before someone steps in to take over the project.

This relatively modest tax increase, which I see as an investment in our future, won't last forever. Previous bonds are being retired, so in six years we will be back to today's tax rate. Huge developments like this cost the community more than they bring in. Our community will have to pay for massive infrastructure projects, road repairs, and increased services like snow plows and police. These ongoing costs will never retire.

Our economy will likely suffer because people will not want to vacation in the midst of 7-10 years of construction right above Main Street. We have spent decades of time and money protecting Park City's historic district. It is one of the things that makes us unique and attractive to tourists.

In Park City our quality of life and our economy both benefit from open space. Please vote YES.
