With summer coming to a close, students in Yates County will soon be back to school! Yates County Sheriff's Office would like to remind parents and guardians that when in and around school zones or driving near school buses, make sure to proceed with caution. LOCATION: Keuka Street, Village of Penn Yan
INCIDENT: DWI Arrest

NAME, AGE, ADDRESS: Bryant C. Miller, 22, of Penn Yan, NY
CHARGE: DWI Common Law (Felony), DWI BAC over .08% or more (Felony), Aggravated DWI BAC .18% or higher (Felony) and No/Inadequate Tail Lamps.

NARRATIVE: Yates County Sheriff Deputies arrested Bryant C. Miller after a traffic stop on Keuka Street in the Village of Penn Yan. While speaking with Miller roadside, he displayed several signs of intoxication. Miller was requested to perform Standardized Field Sobriety Tests and subsequently taken into custody. Miller was then transported to the Yates County Jail for a chemical test. Further investigation also revealed Miller had a previous DWI conviction in 2021. Miller was processed and held at the Yates County Jail to await the next session of CAP arraignment. This arrest was conducted while working the STOP DWI/DWAI Drug Enforcement Crackdown.

2026-10122 DWI arrest


COMPLAINT NUMBER: 2026-10122
DATE AND TIME: 08/30/2026 at 4:49 am
LOCATION: Preemption Road, Town of Benton
INCIDENT: DWI Arrest

NAME, AGE, ADDRESS: Gregory D. Tartt Jr, 41, Syracuse, NY
CHARGE: DWI Common Law (Felony)

NARRATIVE:
On August 30th, 2026 Yates County Sheriff Deputies were advised by the Penn Yan Police Department that a male had left a domestic incident in the Village of Penn Yan and was Driving While Intoxicated. Deputies located the male, identified as Gregory D. Tartt Jr., on Preemption Road in the Town of Benton. A traffic stop was conducted and Tartt showed obvious signs of intoxication and was subsequentially arrested for Felony Driving While Intoxicated. Tartt was then brought to the Yates County Jail where he refused to submit to a chemical test. Tartt was previously convicted of a Driving While intoxicated in 2022 in the City of Auburn. Tartt was turned over to correctional staff to await Centralized Arraignment Proceedings.

Today we said goodbye to one of the most community oriented public servants Yates County has known. Bart has served for decades with the Penn Yan Fire department in so may different capacities. I would like to recognize Mr. Winslow for his service as well with the Yates County Sheriff's Office where he served for many years as the Confidential Assistant to the Sheriff. Thank you Mr. Winslow for your service, wisdom, and friendship. Your legacy will continue on.

DWI Arrest

DATE AND TIME: 8/23/2026 12:38 AM
LOCATION: Middle Road, Town of Potter

INCIDENT: MVA/DWI Arrest
DRIVER: Eric W Mausteller (34) Branchport, NY

CHARGE: Driving While Intoxicated (Felony) Driving with .08% or Greater (Felony), Aggravated Unlicensed Operation 1st (Felony), Obstruction of Governmental administration, Resisting Arrest, Disorderly Conduct, Moved from Lane Unsafely, Failure to Keep Right and Uninspected Motor vehicle.

NARRATIVE: On August 23rd, 2026, around 12:38 AM, Yates County Deputies responded to Middle Road in the Town of Potter for the report of a motor vehicle accident with injuries. Upon arrival, Deputies contacted Eric Mausteller who refused to identify himself and refused a lawful command to step away from the vehicle. Mr. Mausteller then physically resisted apprehension. Further investigation revealed that Mr. Mausteller was the driver of the vehicle and that he displayed signs of intoxication. Mr. Mausteller was arrested and transported to the Yates County Jail where he was held to await CAP Court arraignment.
