Berkshire District Attorney Timothy Shugrue describes the murder as a tragedy, saying the lack of mental health care is leading to 'awful situations.'
NORTH ADAMS, Mass. — Police walked into a "brutal scene" Monday — 67-year-old David Allen Boucher had been stabbed multiple times and left for dead the week before.

His son, David Louis Boucher, 48, had walked into the police station at 11:49 a.m. and told police he had killed his father.

"The victim had been stabbed multiple times, with different objects, sharp objects," said Berkshire District Attorney Timothy Shugrue after Boucher's arraignment for murder on Tuesday morning. "Multiple wounds. Struggle in the bedroom, struggle in the kitchen. The decedent struggled and fought hard. It was a brutal scene."

The attack is believed to have happened on Tuesday, May 5, based on initial evidence including the state of the body and statements made by the defendant, according to the DA's Office.

Boucher had not-guilty pleas entered on his behalf and he is being held without bail at the prosecution's request. He is being held at the Berkshire County House of Correction and is scheduled to appear again in Northern Berkshire District Court on June 12.

Shugrue said it was unclear why Boucher waited a week to inform police but noted the investigation is barely 24 hours old.

The younger Boucher lived downstairs and his father upstairs in the multi-unit family home on Walnut Street.

The DA said the motive isn't clear but it might have been about a gambling debt. He said the younger Boucher has a minor criminal record and that there were indications he had "thoughts about hurting himself, there's evidence of that."

"I think there's some mental health components to this case as well, so we'll be investigating that further," he said, saying family members had indicated as much. "As we've found out, in our rural communities, we do have a great problem with mental health care that lead to these awful situations and family tragedies."


He credited the North Adams Police and members of his office for working overnight "to pull this all together." The street around the home had been blocked off shortly after noon on Monday and investigators worked through the night after executing search warrants at about 11 p.m.

"Everybody worked well together," he said. "They were up all night. ... I finally received the reports about 6:30 this morning. ... It's been a long 24 hours."

The Office of the Chief Medical Examiner took custody of the body. Law enforcement involved in the investigation include the North Adams Police Department; the Berkshire State Police Detective Unit; State Police Crime Scene Services Section; and the State Police Crime Laboratory.

He noted his office has had about nine murder trials in the past two years that have resulted in first and second-degree convictions, including Tuesday morning's conviction in the first degree for Luis Rosado, who killed Jillian Tatro in 2022.

"I built a tremendous legal staff here, I said I was going to build the best law office in Western Massachusetts, I believe I've done that," he said. "When I took this job, I inherited a lot of murder cases and we're going through them quickly. ...

"Unfortunately, we resolved one today and we arraigned one today."

About a half-dozen Boucher relatives were waiting patiently for hours at court as a jury session delayed the arraignment. They declined to comment to press afterward.

Shugrue consoled them, saying, "we're here for you as well. We'll get you through this."

NORTH ADAMS, Mass. — A Berkshire County jury on Tuesday returned a verdict of guilty in the murder of Jillian Tatro four years ago.

Luis Rosado, 53, was found guilty of murder in the first degree with extreme atrocity for stabbing his 38-year-old wife to death in an apartment they shared at 46 Charles St. on May 28, 2022.

He and Tatro had been married five months and during that time, Tatro had sought a restraining order against her husband.

Rosado had been convicted of domestic violence on another individual in October 2020. At the time, he was charged with three counts of assault and battery on a household member, strangulation and larceny and was sentenced to a minimum of a year in the Berkshire County House of Corrections.

He went on trial for murder this past week in Pittsfield and was found guilty by a Berkshire Superior Court jury. Sentencing has not yet occurred.


The conviction was announced on Tuesday morning by Berkshire District Attorney Timothy Shugrue at the arraignment of David L. Boucher, who is charged with murder in the death of his father.

"While we were waiting here this morning, [a jury] returned a verdict of guilty in the first degree, cruel and atrocious behavior. So I don't know when the sentence will be. I don't know whether it will be life without parole," he said. "Obviously, I really want to congratulate the North Adams Police Department and all the departments of law enforcement that worked hard on this case."

Assistant District Attorney Joseph Yorlano tried the case and Shugrue said he was exceptional, along with Assistant District Attorney Amy Winston.

"We have a very good team that worked really hard on this case, and it was an important case. This woman, additionally, was brutally stabbed multiple times," he said. "She died a horrific, awful death, and that's why cruel and atrocious behavior led to a first-degree conviction."

PITTSFIELD, Mass. — An Adams man pleaded guilty on Friday in Berkshire Superior Court to multiple counts of aggravated r**e of a child and aggravated indecent assault and battery on a child under 14.

Brian Warner, 39, was sentenced by Judge Michael K. Callan to 25 to 28 years in state prison.

The defendant pleaded guilty to the following:
Two counts of r**e of a child with force
One count of aggravated r**e of a child
Two counts of r**e of a child, aggravated, five-year age difference
Four counts of indecent assault and battery on a child under 14
Fourteen counts of aggravated indecent assault and battery on a child under 14
Nine counts of posing a child in the n**e
Two counts of possession of child sexual abuse material
Callan attributed the lengthy sentencing to the egregious nature of the defendant's crime. In his sentencing memo, the judge wrote, "In fashioning this sentence I have also considered the Sentencing Guidelines, which were established by a Sentencing Commission created by our Legislature and consisting of prosecutors, defense counsel, public safety and correctional officials, and victim-witness advocates.

"While not mandatory, these guidelines were designed, among other goals, to promote consistency in the sentencing process in our judicial system. The guidelines utterly fail in some circumstances and this is one of them."


Warner produced child sexual abuse material, otherwise known as child po*******hy. In doing this, the defendant r**ed and assaulted a child over a period of two years. Law enforcement uncovered hundreds of images produced by Warner.

"Justice was served today, but Warner's crimes are deeply disturbing. When a child in our community is harmed, it naturally causes us to reflect on how we can do more to protect our children. To the survivor and their [singular] family, this outcome cannot undo the trauma you endured; however, I hope it offers some comfort in knowing that your abuser has been held accountable under the law," stated District Attorney Timothy Shugrue.

Chief of the Child Abuse Unit Andrew Giarolo, an assistant district attorney, represented the commonwealth and Ian Benoit the victim witness advocate on behalf of the DA's Office. The Adams Police Department led the investigation with support from the Berkshire State Police Detective Unit's digital evidence lab.

"I commend the Adams Police Department, the State Police, and the Child Abuse Unit staff, Chief Giarolo and victim advocate Ian Benoit. Investigating and prosecuting these cases are extraordinarily difficult," said Shugrue. "Thank you for your commitment to helping protect children and working to bring justice on their behalf."

This past March, a federal judge sentenced Warner to 28 years in federal prison for three counts of sexual exploitation of a child. The defendant will serve his federal sentence and state sentence concurrently. He will be placed in federal prison first. Upon his release from federal prison, he will serve any remaining time on the commonwealth's sentence in state prison.

Congratulations to our First Assistant District Attorney Marianne Shelvy that I was proud to nominate for Massachusetts Prosecutor of the Year for 2026 (for work in 2025). She won the award along with First Asst DA Steve Gagne from Northwestern DAs Office out of 884 Assistant District Attorneys in the state of Massachusetts. The first female ADA to win in Berkshire County and only one of 4 winners from the county in the last 33 years since the awards inception. I pledged to make the Berkshire District Attorney’s Office the best law office in Western Massachusetts and we have done that with tremendous attorneys- there are 25 other great lawyers in the office but Marianne is now the best in the state of Massachusetts- which we already knew.
