TALLAHASSEE, Fla. โ Florida Attorney General James Uthmeier launched a formal investigation into Major League Baseball on Friday, issuing a sweeping subpoena over allegations that the league is engaging in illegal religious discrimination against Christian players.
The probe centers on whether MLB selectively enforces its uniform policies by permitting secular or social justice messaging while penalizing expressions of religious faith.
โMajor League Baseball claims it does not tolerate discrimination based on religion, yet its actions tell a different story,โ Uthmeier stated on X when launching the probe. โIf MLB applauds ideological messages it prefers while reprimanding expressions of Christian faith, that is not neutral rule enforcementโit is religious discrimination that cannot stand in Florida.โ
The stateโs investigation follows warnings issued by MLB to three San Francisco Giants pitchersโLanden Roupp, JT Brubaker, and Ryan Walkerโwho hand-wrote references to a Bible verse on their caps during the teamโs โPride Nightโ game. The verse, Genesis 9:12-16, describes the rainbow as a sign of Godโs covenant with humanity.
Roupp stated the markings were intended to symbolize โGodโs covenant andโฆ his faithfulness and his mercy.โ
MLB officials defended the warnings, clarifying that uniform regulations strictly prohibit any player from writing, attaching, or embroidering unofficial messages on their apparel or equipment, regardless of the content. The league stated that the verbal warnings were routine, non-disciplinary, and applied consistently to all unauthorized writing.
However, in a formal letter to MLB Commissioner Robert D. Manfred, Jr., accompanying the subpoena, Uthmeier challenged that narrative, citing a recent history in which MLB allegedly approved or overlooked unauthorized uniform alterations for preferred causes. In the letter, the attorney general detailed explicit examples of permitted secular expressions, including:
Sweeping 2020 policy exceptions that allowed Black Lives Matter patches on jersey sleeves and the BLM logo stenciled directly onto the pitcherโs mound.
Players utilize their cleats to display custom social justice messages and causes.
A Cincinnati Reds player wrote on his cap in 2019 to honor the victims of a mass shooting.
Several Toronto Blue Jays and Los Angeles Dodgers pitchers were writing the number โ51โ on their caps in 2021 to honor a fellow player.
Los Angeles Angels star Mike Trout is writing the score of Super Bowl LIX on his bat k**b in 2025, which was later memorialized on a baseball card.
โThe Leagueโs erratic enforcement of its rules appears discriminatory,โ Uthmeier stated, warning that the practice of claiming neutrality while targeting religious views could violate both the Florida Civil Rights Act and the Florida Deceptive and Unfair Trade Practices Act. The stateโs civil rights law explicitly prohibits employers from treating employees less favorably based on their religion.
The investigative subpoena commands MLB to produce a vast trove of internal records by July 23. Requested documents include complete enforcement logs since 2020, internal communications regarding the decision to warn the Giants pitchers, and specific league policies regarding โPride Nightโ apparel expectationsโincluding whether players face adverse consequences for opting out on religious grounds.
While the targeted pitchers belong to a California-based franchise, the subpoena specifically covers records relating to players and personnel of the Miami Marlins, the Tampa Bay Rays, and the 15 Major League teams that operate Grapefruit League spring training facilities across Florida.
