On December 3, 2024, at approximately 7:45 p.m., 22‑year‑old Rayleen Mia Vasquez was driving east on NM 267 when a wrong‑way driver in a 2004 Chevrolet extended‑cab pickup truck collided with her. Police reports confirm she was wearing her seatbelt, had her lights activated, and was driving in her lane. Rayleen was pronounced deceased at the scene, her Nissan Kicks crushed and her life robbed on NM 267, 48 meters west of South Roosevelt Road V in Portales, New Mexico, Roosevelt County. The pickup’s driver, 31‑year‑old Fredy Osman Marin Portillo, was seen exiting his truck with a bleeding male toddler before fleeing westbound on foot. There was no child restraint in the pickup truck. Inside the truck, officers found a utility statement listing Portillo’s residence half a mile west of the crash site, along with a Honduran passport that a witness confirmed accurately matched the man who fled. Roosevelt District Attorney Jake Boazman approved a search warrant for Portillo’s residence, which was found empty upon entry, though four vehicles were parked outside.
The next day, New Mexico State Police received a report that the injured toddler, his mother (Portillo’s wife), and a friend had arrived at Roosevelt General Hospital in Portales, NM, at approximately 1:30 p.m. NMSP observed the toddler had sustained a broken arm and body bruising from the fatal collision. Portillo’s wife told officers that Fredy had dropped the toddler off after the collision the night before, and she gave the toddler pain killers before going to a friend’s home. She stated she did not know her husband’s whereabouts. The friend accompanying her provided police with Portillo’s location, and NMSP arrested him without incident at around 4 p.m. on Wednesday, December 4, 2024, at a residence in Portales. Portillo was booked into the Roosevelt Detention Center at 8:00 p.m. on three counts: Accident Involving Death or Personal Injuries (fourth‑degree felony), Abandonment or Abuse of a Child (third‑degree felony), and Driver Must Be Licensed (misdemeanor), all marked No Bond. The District Attorney also reported that Portillo had previously been deported from Texas in 2016.
Portillo’s first felony appearance was scheduled for 1:30 p.m. on December 5, 2024, before the Honorable Judge Christopher Mitchell. At approximately 1:00 p.m., the Crash Reconstruction Unit determined that Portillo did not have his headlights activated at the time of the collision. He was released at 1:55 p.m. on a Personal Recognizance bond. On December 6, 2024, an Amended Criminal Complaint was filed at 3:01 p.m., increasing the charges to five counts: Abuse of a Child Resulting in Great Bodily Harm (first‑degree felony), Homicide by Vehicle (Reckless Driving) (third‑degree felony), Leaving the Scene of an Accident (Great Bodily Harm or Death), Open Container (Possession) (penalty‑assessment misdemeanor), and No Driver’s License (motor vehicle code misdemeanor). Portillo was again allowed to remain on his PR bond. A Waiver of Appearance was approved for his next court date on December 24, 2025. He was indicted by a Grand Jury on January 3, 2025. On February 5, 2025, his bond was revoked after his residence was found vacant, and another warrant was issued on February 25, 2025, for Failure to Appear in Court. Despite repeated pleas from the victim’s family, Portillo was never placed on an ankle monitor. Fredy Osman Marin Portillo has not been brought to justice to this date.
