Repeal9.31 Repealing Mendocino Chapter 9.31 of Title 9 /for immediate release. Repeal Mendocino Chapter 9.31 of Title 9 of the Mendocino County Code. June 2, 2011

Jim and Trelanie Hill, residents of Potter Valley, California today
submitted to the Mendocino County Clerk's office a Notice to Circulate
a Petition for the purpose of proposing to the voters of Mendocino
County, a repeal of Chapter 9.31 of Title 9 of the Mendocino County
Code. The purpose of repealing 9.31 as stated in the filing is to:
1. To ensure that seriously ill Mendocino County resident

s have the
right to obtain, cultivate, and use ma*****na for medical purposes
where that medical use is deemed appropriate and has been recommended
by a physician who has determined that the person's health would
benefit from the use of ma*****na in the treatment of cancer,
anorexia, AIDS, chronic pain, spasticity, glaucoma, arthritis,
migraine, or any other illness for which ma*****na provides relief.

2. To ensure that patients and their primary caregivers who obtain,
cultivate, and use ma*****na for medical purposes upon the
recommendation of a physician are not subject to civil prosecution or
sanction.


3. To ensure that patients who exercise their right to cultivate and
use medical ma*****na will not be subject to an unreasonable
obligation to financially support the Sheriff Department's retirement
and pension program by an ordinance that uses fees, from only the
seriously ill patients, exercising their rights under proposition 215,
to supplement other obligations and expenses already the
responsibility of the Sheriff department. Contact information:

Ma*****na is not medicine, your doctor is a liar, you just want to get high, your doctor is a liar, how can something you smoke be medicine, your doctor is a liar, believe me I know, I attended a junior college for 2 years, I also have training from the academy and they say your doctor is a liar,
Who do you trust, the policeman or your doctor, who do think lies!

I have sick friends and I have healthy friends. I wouldn't want to fund public safety positions with money from just my sick friends. Why does the Board of Supervisors just want to tax their sick friends and not tax their healthy friends? Is that what the public wants?

The intent to circulate a petition was delivered to Mendocino County Counsel on June 3, 2011. County Counsel has 15 days to prepare a ballot title and summary.

Allman predicted his program would issue 100 permits. As of Friday, the Sheriff's Office had received 41 permit applications since January.

"I think we're still on track for 100," Allman said.

Referring to Smith's "funny money" comment, Allman said, "You can call it whatever you want, but if it keeps deputy sheriffs on the streets there's nothing funny about it."

District Supervisor Kendall Smith and others on the board called the sheriff's projections "funny money," pooh-poohing the idea and opting instead to approve seven layoffs in his department. The decision meant a net loss of two correctional officers in the county jail after two deputies were transferred to positions paid for with federal grant money and two sergeants took pay cuts when they were demoted to deputies

Allman stood before the Mendocino County Board of Supervisors in January to ask for more time before the board approved the latest round of layoffs for his department, saying the money from the medical ma*****na program was expected to start rolling in around the beginning of spring, when growers began planting.

Since these fees (or more correctly described as taxes)are only levied on medical growers, should patients and only patients be responsible for funding the layoffs in the sheriff department?
Funny money? Keeping deputies on the street by only taxing the most weak and ill among us isn't very funny to me.

How can the revenue be used to keep sheriff deputies on the steet? The revenue is intended to cover the cost of implementing the zip tie program not other sheriff department expenses. 9.31 is a land use regulation and the cost of permitting 99 plants is $7,950 per year. In contrast, Butte county cost of permitting 99 plants is $285.00.
