The U.S. Supreme Court has dismissed Hamm v. Smith, leaving intact the constitutional protection against executing people with intellectual disabilities established in Atkins v. Virginia.
At the center of the case was whether IQ scores alone should determine intellectual disability — or whether courts must continue using a broader clinical evaluation that includes adaptive functioning and developmental history.
Disability advocates warned that narrowing the definition could have far-reaching consequences beyond death penalty cases, potentially affecting access to services and legal protections nationwide.
For now, established medical and legal standards remain in place: intellectual disability cannot be reduced to a single number.
