It’s kind of like saying “I can do what your lawyer can do but only better (and for less money)”😝

In forty nine states, a notary stamps your paperwork and waves you out the door. In Louisiana, the notary might just run your whole legal life. ⚖️😅

Blame the French and the Spanish. While the rest of America built its law on the English common law tradition, Louisiana kept the civil law system its colonial founders brought with them, rooted in Roman and Napoleonic code. And in that tradition, the notary is not a person who simply witnesses a signature. The notary is a powerful public official.

A Louisiana notary can draft your will, prepare your contracts, handle the sale of your house, authenticate acts, and create documents that carry the full weight of law, work that in other states you would need a lawyer to touch. Historically, becoming a notary here was a serious profession passed down through families, a position of real authority in the community.

It is one of a hundred little ways Louisiana quietly refuses to be like everywhere else. We do not have counties, we have parishes. We do not inherit the way the rest of the country does, we have forced heirship. And when you need something made official, you do not always run to a lawyer. You go see the notary, and you treat that person with respect. 📜

To outsiders it sounds like a charming quirk. To Louisiana folks it is just Tuesday, one more thread in a legal culture that still thinks and sometimes still speaks in French. Two hundred years after the flags changed over Jackson Square, the old law is still very much alive.

So the next time someone from another state brags about their fancy attorney, just smile. In Louisiana, the notary already handled it. ⚜️

Did you know about this part of Louisiana law???

Only in Louisiana can your children legally own the family home while your mama still has every right to live in it. Welcome to usufruct. 🏠

If you have Louisiana roots, you may have run into this at the reading of a will and wondered if the lawyer was making it up. He was not. Louisiana is the only state in the country that does not follow English common law. Our civil law system comes straight from the French and Spanish who built the colony, and it gave us a concept most Americans have never heard of, the usufruct.

Here is the plain version. When a married person dies in Louisiana, the law often splits their property in two. The ownership of the deceased's share can pass down to the children, they become the naked owners. But the surviving spouse is frequently given the usufruct, the legal right to use, live in, and even draw income from that property for the rest of their life. So on paper the kids own Mama's house. In reality, Mama is not going anywhere, and the law is firmly on her side. ⚖️

It sounds like a family sitcom, but it is actually a piece of old world wisdom. The idea protects the widow or widower from being pushed out of their own home by heirs, while still guaranteeing the children inherit in the end. Ownership and use, split cleanly between the generations. The French built it. Louisiana kept it. And every other state just stares.

This is why probate in Louisiana confuses lawyers from everywhere else, why our legal words sound French, why our parishes are not counties, and why so much of daily life here quietly runs on rules Napoleon would recognize.

You can leave Louisiana. You can lose the accent. But the moment somebody passes and the will is read, the old French law reaches out and reminds you exactly where you come from.

In Louisiana, even inheritance has an accent.
