With school starting in a few days, we are asking families to talk with their students about a new Washington state law regarding e-bikes and other electric vehicles.

Washington state has updated its definition of an electric-assisted bicycle, or e-bike. Under the new law (ESSB 6110), a legal e-bike must have fully operable pedals, a motor with a power output of no more than 750 watts, and meet the requirements for a Class 1, Class 2 or Class 3 e-bike.

The law also provides greater clarity about the distinction between legal e-bikes and higher-powered electric vehicles. Some vehicles that do not qualify as e-bikes may instead fall under Washington's existing motorcycle or moped laws, which can include requirements for registration, a driver's license, motorcycle endorsement, helmets and other equipment.

A vehicle that can travel faster than 20 mph using only its electric motor is not considered an e-bike under Washington state law. Vehicles designed, manufactured or intended by the manufacturer or seller to be easily configured to exceed legal e-bike requirements, such as by flipping a switch, pushing a button or changing a software setting, also do not qualify as e-bikes.

This distinction is especially important for some of the higher-powered electric bikes and dirt-bike-style vehicles that have become popular with teens. Simply having pedals or being marketed as an "e-bike" does not necessarily mean a vehicle legally qualifies as an e-bike in Washington.

IMPORTANT: Many of our schools have rules about riding bikes, e-bikes and scooters on campus. Some require students to dismount and walk their bike or scooter once they are on school property. These rules are in place for the safety of students, staff and others on campus. Please check with your school for its specific rules regarding bicycles, e-bikes, scooters and other wheeled vehicles.
