Welcome 2022! Summaries from 2021 continued: Today's review addresses the Medical Services Facility Request for Proposals, Interviews, and Outcomes. Sometimes the end is not exactly what you had in mind when you started, but that isn't necessarily a bad thing!

On March 22, 2021 the Commissioners Court approved the terms and issuance of a Request for Proposal (RFP) to identify an operator(s) for a proposed medical facility to be funded by a $10 million grant from the Texas General Land Office (GLO). The stated purpose of the project and associated facility was to enhance and increase medical services in the community, including those facilities lost in the region due to Hurricane Harvey and COVID. Both private and not-for-profit entities were encouraged to submit proposals. The scope of the RFP encouraged proposals for the following uses:
• Hospital
• Outpatient facilities
• Ambulatory Surgery Center
• Federally Qualified Health Center
• Rural Health Clinic
• Urgent Care Center
• Other medical services and facilities to enhance services in Aransas County

Local individuals with previous or current medical experience were appointed to the Selection Committee: Commissioner Pat Rousseau, Nancy Kinkler, Dr. Ronald Bruce, Jennifer Racette, Grant Douglass, and Matt Brewington. All had medical backgrounds and included hospital administrators, medical educators, a practicing physician, and medical-staffing recruiters. Aransas County issued the RFP and sent out approximately 160 invitation notices. The bid process closed on May 27, 2021. The County received three responses to the RFP; two were considered responsive and one was unresponsive (insufficient information provided). The proposals were for a Federally Qualified Health Center (FQHC) from Amistad and an ambulatory surgery center from HCA.

The Selection Committee met, scored the proposals, and developed follow-up questions to be used in conducting independent interviews with both of the qualified proposers. The committee also met with the County Treasurer to receive information about the uses for the County’s Health Care Sales Tax and the Indigent Care Fund. In July, the Selection Committee met with the two proposers and conducted interviews. A recommendation was made to the Court by the Selection Committee to award contracts to both entities, Amistad for an FQHC and HCA for their revised proposal. NOTE: HCA determined that an ambulatory surgical center would not be financially viable for several years so they proposed an expansion of their emergency room services instead.

Aransas County signed a Memorandum of Understanding with Aransas County Medical Services Inc. (ACMSI) to partner on the medical facility project. The agreement provided for the new facility to be located at 400 Enterprise Drive, a site owned by ACMSI. The agreement stated that ACMSI would have final ownership of the facility. As such, ACMSI would coordinate with Aransas County on the operating agreement to ensure grant compliance, but ACMSI would lead the contract negotiations. An amendment to the grant needed to be approved by GLO before contracts could be signed. The use of the grant proceeds had changed from a micro-hospital to two medical services facilities. The construction period needed to be extended by approximately 24 months to allow for the delay in negotiations. Neither of these amendments to be requested had guaranteed approval from GLO.

The final decision was that HCA would work independently with ACMSI on the expansion of the Rockport 24/7 Emergency Room and grant funds would not be used for that endeavor. Amistad is currently looking for a location in Aransas County to serve its target population. The County may find a way to assist Amistad without using the GLO grant to acquire property. The Commissioners Court recently sent an amendment requesting GLO to approve combining the $10 million grant with other Hurricane Harvey GLO funded mitigation projects (drainage, stormwater, road repairs) which are experiencing cost overruns. A response is expected within the next 1-4 months.

Welcome to 2022. I thought that I would share a review of my first year in office as Precinct 3 County Commissioner. While Commissioners Court is scheduled to semi-monthly, the work actually involves meeting with assorted department heads, individuals, and officials every week for different purposes. Responding to the phone requests, texts, and personal inquiries of my constituents and County residents in general is certainly important work. Even if I am not able to resolve every problem, I want to insure that the person received information that was helpful or clarified his or her issue

For the next several days, I will post summaries of the major undertakings and/or accomplishments of the past year.

American Rescue Plan Act (ARPA): The County received about $4.5 million from the Federal Government to use as mitigation for the negative impact of COVID-19. Although initially I proposed a committee that would include members of the community such as school district, hospitality, & non-profits, the Court appointed two Commissioners (Casterline and Rousseau), a member of the Long Term Recovery Team (Foutz), and County Auditor (Cockerham). Members sought input from community groups and leaders on recommended and eligible projects. A final list was voted upon for funding approval at the Commissioners Court meeting on 9/27/2021:.
• Personal Protective Equipment (PPE), COVID test kits, Sanitization products ($250,000)
• Records storage and management/accessibility to public – District Clerk’s office ($1,000,000)
• Records storage and management/accessibility to public – County Clerk’s office ($1,000,000)
• Potable water storage tank for Jail and protective barrier for tank ($100,000)
• Website development and redesign ($70,000)
• 3 Portable message trailers to improve public communication, total cost for 3 trailers ($50,000)
• Infrastructure construction/repair to protect clean water ($1,500,000)
• Generator for Animal Control facilities ($90,000)
• Generator for AgriLife Extension office ($90.000)
• GrantWorks administration estimated fees ($150,000)

Total estimated amount of recommended projects: $4,300,000

Other proposals considered but not recommended at this time:
• Fiber optic (loop and last mile), project not likely to be approved with SLFRF but may qualify under competitive funds.
• Affordable housing, no feasible option presented that was likely to be approved.
• Childcare needs and facility, need more clearly defined request. May qualify as FEMA Public Assistance Project.
• Education, not likely to be approved
• Tourism, non-profits’ suggestions: billboards, tourism shuttle bus, Art Center expansion; projects not likely to be approved
• Healthcare, funding recommended above for PPE and test kits, allocation made in FY 2022 Budget from Health Care Sales Tax fund.
• Workforce facility/training; Del Mar College is requesting funding via the ARPA EDA competitive Good Jobs Challenge Grant.
• Water and wastewater improvements, addressed above.
• Fire department equipment and other eligible uses, may qualify under competitive funds.

Requests for Proposals (RFPs) have been issued and received for some of the projects. Contracts have been approved and work either has begun or will soon be underway.

Early voting is available today, 10/29/21, from 7AM to 7PM at the Aransas County Elections Office for the Proposed Amendments to the Texas Constitution. If you wait to vote until Tuesday, November 2nd, you will need to go to one of the four election centers: Rockport Volunteer Fire Dept, Rockport G I Forum, Fulton VFD, or Rockport Service Center/City Hall. The eight proposed amendments follow:

Proposition Number 1 HJR 143 proposes a constitutional amendment expanding the circumstances in which a professional sports team charitable foundation may conduct raffles to raise money for the foundation’s charitable purposes. The proposed amendment would allow professional sports team charitable foundations of organizations sanctioned by the Professional Rodeo Cowboys Association or the Women’s Professional Rodeo Association to hold charitable raffles at rodeo events.
The proposed amendment will appear on the ballot as follows: “The constitutional amendment authorizing the professional sports team charitable foundations of organizations sanctioned by the Professional Rodeo Cowboys Association or the Women’s Professional Rodeo Association to conduct charitable raffles at rodeo venues.” (I oppose raffles as a form of gambling.)

Proposition Number 2 HJR 99 proposes a constitutional amendment allowing the legislature to authorize a county to issue bonds or notes to finance the development or redevelopment of an unproductive, underdeveloped, or blighted area within the county and to pledge for repayment of those bonds or notes increases in property tax revenues imposed on property in the area by the county. The Texas Constitution gives the legislature the power to authorize an incorporated city or town to issue such bonds or notes but does not expressly give the legislature the power to grant that same authority to counties. The proposed amendment also provides that a county that issues bonds or notes for transportation improvements may not pledge for the repayment of those bonds or notes more than 65 percent of the increases in ad valorem tax revenues each year, and a county may not use proceeds from the bonds or notes to finance the construction, operation, maintenance, or acquisition of rights-of-way of a toll road.
The proposed amendment will appear on the ballot as follows: “The constitutional amendment authorizing a county to finance the development or redevelopment of transportation or infrastructure in unproductive, underdeveloped, or blighted areas in the county.” (I oppose the creation of another taxing entity that would raise taxes for homeowners.)

Proposition Number 3 SJR 27 proposes a constitutional amendment barring the State of Texas or a political subdivision from enacting, adopting, or issuing a statute, order, proclamation, decision, or rule that prohibits or limits religious services. The proposed amendment would apply to religious services, including those conducted in churches, congregations, and places of worship, in the state by a religious organization established to support and serve the propagation of a sincerely held religious belief.
The proposed amendment will appear on the ballot as follows: “The constitutional amendment to prohibit this state or a political subdivision of this state from prohibiting or limiting religious services of religious organizations.” (I support creating safeguards for religious institutions.)
Proposition Number 4 SJR 47 proposes a constitutional amendment changing certain eligibility requirements for a justice of the Supreme Court, a judge of the Court of Criminal Appeals, a justice of a court of appeals, and a district judge. The proposed amendment provides that a person is eligible to serve on the Supreme Court if the person, among other qualifications, is licensed to practice law in Texas; is a resident of Texas at the time of election; has been either a practicing lawyer licensed in Texas for at least ten years or a practicing lawyer licensed in Texas and a judge of a state court or county court established by the legislature for a combined total of at least ten years; and during that time has not had the person’s license to practice law revoked, suspended, or subject to a probated suspension. The same eligibility requirements would apply to a judge of the Court of Criminal Appeals and to a justice of a court of appeals. The proposed amendment further provides that to be eligible for appointment or election as a district judge, a person must be a resident of Texas; be licensed to practice law in Texas; and have been a practicing lawyer or a judge of a court in Texas, or both combined, for eight years preceding the person’s election, during which time the person’s license to practice law has not been revoked, suspended, or subject to a probated suspension.
The proposed amendment will appear on the ballot as follows: “The constitutional amendment changing the eligibility requirements for a justice of the supreme court, a judge of the court of criminal appeals, a justice of a court of appeals, and a district judge.” (I support strengthening the requirements for judicial candidates.)

Proposition Number 5 HJR 165 proposes a constitutional amendment allowing the State Commission on Judicial Conduct (SCJC) to accept complaints or reports, conduct investigations, and take any other authorized action with respect to a candidate for a state judicial office. Currently, the Texas Constitution only permits the SCJC to take such actions as to persons holding a judicial office.
The proposed amendment will appear on the ballot as follows: “The constitutional amendment providing additional powers to the State Commission on Judicial Conduct with respect to candidates for judicial office.” (I support the vetting process for judicial candidates.)

Proposition Number 6 SJR 19 proposes a constitutional amendment establishing that residents of certain facilities have the right to designate an essential caregiver with whom the facility may not prohibit in-person visitation. The proposed amendment would apply to a nursing facility, assisted living facility, intermediate care facility for individuals with an intellectual disability, residence providing home and community-based services, or state supported living center. The proposed amendment also would authorize the legislature to provide guidelines for these facilities to follow in establishing essential caregiver visitation policies and procedures.
The proposed amendment will appear on the ballot as follows: “The constitutional amendment establishing a right for residents of certain facilities to designate an essential caregiver for in-person visitation.” (The state of Texas should not be allowed to infringe on the rights of caregivers' access to loved ones.)

Proposition Number 7 HJR 125 proposes a constitutional amendment permitting a person who is 55 years of age or older at the time of death of their spouse who is receiving a limitation on school district property taxes on their residence homestead on the basis of a disability to continue receiving the limitation while the property remains the surviving spouse’s residence homestead.
The proposed amendment will appear on the ballot as follows: “The constitutional amendment to allow the surviving spouse of a person who is disabled to receive a limitation on the school district ad valorem taxes on the spouse’s residence homestead if the spouse is 55 years of age or older at the time of the person’s death.” (Neutral, this will provide a benefit to the surviving spouse but decrease the tax base.)

Proposition Number 8 SJR 35 proposes a constitutional amendment authorizing the legislature to exempt from ad valorem taxation all or part of the market value of the residence homestead of the surviving spouse of a member of the United States armed services who is killed or fatally injured in the line of duty. The Texas Constitution provides a property tax exemption to the surviving spouse of a member of the armed services who is killed in action, but the current exemption does not include members of the military who die during their service due to injuries sustained that are not combat-related.
The proposed amendment will appear on the ballot as follows: “The constitutional amendment authorizing the legislature to provide for an exemption from ad valorem taxation of all or part of the market value of the residence homestead of the surviving spouse of a member of the armed services of the United States who is killed or fatally injured in the line of duty.” (I support the extension of the exemption.)

Two important meetings are scheduled at the City of Rockport's Public Service Center located at 2751 State Highway Bypass.

One is Monday, July 19th at 5:30 PM. The Planning & Zoning Committee is meeting to discuss two small amendments in the Comprehensive Plan involving "Mixed Use" zoning. This was a very hot topic at last week's City Council meeting.

The second meeting is Tuesday, July 20th at 1:30 PM. The City Council is holding a workshop to hear/discuss the Master Drainage Plan and to hear/discuss Drainage Utility Districts. After the tremendous amount of flooding and damage that resulted from the rainstorm last week, these are critically important topics for our residents. WALK-IN VACCINATION CLINIC TO BE HELD MARCH 17-18

The Texas Division of Emergency Management will be hosting a free, walk- in COVID-19 vaccination clinic on Wednesday, March 17 and Thursday, March 18 at the Fulton Convention Center (Paws and Taws), which is located at 402 N. Fulton Beach Rd. There will be no appointments for this event.
The vaccinations will begin at 8 am and will continue throughout the day until the allocated doses have been used. As of Monday, March 15, individuals who are 50-64 years of age have been added to the list of eligible recipients.
Participants are asked to park in the legal parking locations adjacent to Center. Please enter the building through the front door and you will be directed by staff. This location offers access services for people with disabilities and those with other functional needs. If you need any assistance, please alert the staff upon arrival.
Social distancing and safety precautions will be in place and masks are required. At this time, there has not been a notification as to which vaccine will be offered.

Two updates for our community as of 3/8/2021. #1. The Rockport Beach Park will be closed to vehicle traffic on Wednesday, 3/10/2021. Aransas County Medical Services has received an allocation of covid vaccines and is contacting people who have signed up with them. The vaccinations will be administered on Wednesday and are only for people who have an appointment. NO vaccines will be available to other individuals. The Beach Park is the location for the distribution of these shots. If you wish to park near the Festival Grounds, you may access the beach by walking in. #2. Aransas County will begin issuing Trash Cards for BRUSH ONLY on Wednesday, March 17, 2021. The trash cards will be handed out at the Aransas County Environmental Health building located at 872 Airport Rd. from 8A-12 and 1P-4 on WEDNESDAYS ONLY. THERE IS A LIMITED AMOUNT OF CARDS AVAILABLE. Trash cards are good for 500 pounds of brush and ANY AMOUNT ABOVE THE 500 LBS MUST BE PAID FOR AT THE TIME OF DISPOSAL. The Aransas County Transfer Station accepts CASH OR CHECKS ONLY and the Hours of Operation are 9am - 4:45pm on Tuesday - Saturday.
PROOF OF RESIDENCY REQUIRED.

Information about yard waste and clean-up following the freeze:
Option 1: The County will begin issuing "trash cards" within the next two weeks to residents of the County who can show proof that they live here. Approximately 60 permits will be issued per week at the Environmental Health Services office on Airport Road (next to Animal Control). The permit/trash card allows you to bring up to 500 lbs. of leaves/yard waste to the Transfer Station. If you have bagged the waste, you will need to slice open the bags to dump the waste at the brush pile and take the bags home with you. Be sure to tell the clerk at the weigh station that you have yard waste, not garbage (garbage will not be accepted with the trash card). If your load is over 500 lbs, you will need to pay either cash or check for the excess.
Option 2: The city will pick up bagged yard waste in April. Since our regular garbage pick-up day is Friday, our schedule for yard waste is Saturday. Maximum of 12 bags per residence will be picked up per stop.

Latest update that I have regarding the covid vaccines was released Friday, 1/22/21.

COVID-19 VACCINE CLINIC SUCCESSFUL;
NEW VACCINATION WAITLIST IMPLEMENTED
Due to the efforts by community leaders and elected officials, the Rockport-Fulton community was able to get 300 vaccines to test the area’s ability to successfully host a COVID-19 vaccine drive-through event in Aransas County on Wednesday, January 20, 2021.
DSHS Public Health Region 11 Medical Director and staff were present to monitor how our event proceeded. A list of individuals meeting Schedule 1A and 1B requirements were received from various non-profit organizations, physician offices and other programs as trial candidates. The process identified a few minor logistical changes that will be made in the future, overall, the event was successful. Event organizers hope to receive a positive response from DSHS to allow them to provide the vaccine on a regular basis within Aransas County.
In the past, community leaders have been given as little as 12 hours’ notice of a vaccine. Note that Aransas County Medical Services, Inc., (ACMSI) is not a COVID 19 vaccine provider. ACMSI is compiling a list to assist our community and encourages citizens to continue to find vaccines wherever available.
Community leaders ask that the public remain patient as they work through this process and the state and federal governments make vaccine available. Information will be posted as it is made available through the local government web sites, social media and the newspaper.
Residents are invited to put their name and phone number on a list to be contacted for future vaccination events, please go to https://forms.gle/kLvfut9h1S7nC2759 to sign up. If a resident does not have access to a computer, they should send a letter with their name and contact phone number to: Vaccination, Aransas County. 2840 Hwy 35 N. Rockport, TX 78382. Information will not be taken by phone from any entities.
This list is for priorities 1A and 1B only. This program is separate from the vaccinations being offered by local pharmacies and others. This list does not guarantee anyone the vaccine, it simply lets organizers know you need the vaccine.
As a reminder, Aransas County residents are NOT restricted to receiving the vaccine within the County. Yesterday, I was privileged to attend the ribbon-cutting, grand opening of the Corpus Christi Medical Center's (CCMC) ER 24/7. Rockport's facility is located at 400 Enterprise Blvd., across from the U.S. Post Office and Memorial Park. A note of gratitude to all of those who worked diligently to recruit a new emergency care provider for Aransas County, especially to Patricia Arnold and the board members of the Aransas County Medical Services, Inc (a 501(c)3 organization that works tirelessly to bring better healthcare services to Aransas County). Thank you also to the leadership of CCMC and special thanks to the new C.E.O. Eric Evans who gave an impromptu invocation before addressing the crowd of supporters!
