Recent public commentary regarding the Williams arraignment has created confusion about the respective roles of prosecutors and judges in criminal proceedings.
At the hearing in front of Judge Dixson, prosecutors requested supervised release with multiple public safety restrictions, including conditions designed to prevent Mr. Williams from being alone with minors. Those requests reflected serious concerns regarding the allegations and the potential risks presented in the case.
Under California law, misdemeanor defendants are frequently released pending trial, often with few or no conditions. In this case, prosecutors sought substantially greater restrictions than would ordinarily be imposed in a routine misdemeanor matter.
Judges ultimately determine the release conditions that govern a defendant while a case is pending. The final release order — including the classroom exception that has been the subject of recent public discussion — was crafted and entered by the court.
The Placer County Deputy District Attorneys Association continues to believe that Mr. Williams should not have been permitted to be alone with children absent the presence of a responsible adult while this case was pending.
