🚨 DWI Enforcement Notice

The San Benito Police Department, in partnership with TxDOT, will be conducting STEP DWI enforcement through September 7, 2026.
Drivers are reminded to never drink and drive. If you plan to consume alcohol, make a safe plan to get home—use a designated driver, rideshare, or another safe transportation option.

The Law

In Texas, a person is legally intoxicated and may be arrested and charged with DWI with a .08 BAC (blood or breath alcohol concentration). However, a person is also intoxicated if mentally or physically impaired due to alcohol or other drugs regardless of BAC. Drivers and passengers can be fined up to $500 for having an open alcohol container in a vehicle.

If someone convicted of intoxication manslaughter kills a parent with young children, they are required to pay child support until the children are 18 years old.

TxDOT's Summer Impaired Driving campaign reminds motorists of the deadly risks of impaired driving and urges them to drive sober and drive like a Texan: kind, courteous and safe.

No one gets behind the wheel intending to cause harm, but 1,254 people died on Texas roads because of impaired driving in 2025. That's three Texans killed each day. And the dangers are even greater if drivers combine substances. In fact, when alcohol and THC are used together, drivers are 25 times more likely to cause a fatal crash.

It's also important to remember that causing a crash isn't the only potential outcome when driving under the influence of drugs or alcohol. A DWI can cost up to $17,000 in fines and fees, jail time, loss of a driver's license, community service, court appearances, court-ordered classes, difficulty finding or keeping a job, loss of trust from loved ones and a lifetime of regret. Probation may also include regular drug or alcohol tests or having a breathalyzer installed in your car to start it.

Whether it's alcohol, THC, cold medicine, prescription drugs or anything else, remember that any high can lead to a DWI. Always choose a sober ride by designating a driver who won't be drinking any alcohol or taking any other kind of drug, calling a sober friend or family member to give you a ride, using a rideshare or taxi service, taking public transit, or staying put until you are sober.
