Community Advisory: E-Bike Safety and Enforcement
With the arrival of spring, the Schuylkill Haven Borough Police Department is reminding parents, guardians, and riders that Pennsylvania law regulates the use of electric bicycles, also known as pedal cycles with electric assist.
Under 75 Pa.C.S. § 3514, no person under 16 years of age may operate a pedal cycle with electric assist. Pennsylvania law defines a pedal cycle with electric assist as a vehicle weighing not more than 100 pounds, equipped with operable pedals, an electric motor rated at not more than 750 watts, and capable of no more than 20 mph on a level surface when powered by the motor alone.
Sixteen years and older E-bike operators must obey applicable traffic laws when operating on public roadways. Under 75 Pa.C.S. § 3501, riders of pedal cycles on roadways have the rights and duties applicable to drivers of vehicles.
Sixteen years and older E-Bike operators are also reminded that sidewalk operation has restrictions. Under 75 Pa.C.S. § 3508, riders must yield to pedestrians and give an audible warning before passing. Pedal cycles may not be operated on sidewalks in the Schuylkill Haven business district.
Parents and guardians should be aware that 75 Pa.C.S. § 3503 prohibits a parent or guardian from authorizing or knowingly permitting a child to violate the pedal cycle provisions of Title 75.
The Schuylkill Haven Borough Police Department will be enforcing applicable Pennsylvania Vehicle Code provisions on borough streets, public roadways, sidewalks, parks, and borough-owned property. Our goal is voluntary compliance and safety for riders, pedestrians, motorists, and the community.
