The Chief Justice of the NC Supreme Court issued an order today, effectively closing the courts of this state for 30 days. This is in response to the growing concern over the coronavirus. During this time, the District Attorney's offices in Lincolnton and Shelby will be operating as normal. The courts in this district will continue to function in a limited capacity. If you have a criminal matter docketed in the coming weeks, please check with your attorney or feel free to call our office.

Congratulations to ADA Kyle Smith on his conviction of Stanchun Brooks. A Lincoln County jury recently found him guilty of Possession of a Fiream by a Convicted Felon, Felonious Carrying a Concealed Handgun and Possession of Marijuana. After admitting to his Habitual Felon status, the Court sentenced him to an active term of 72 to 99 months in the NC Dept of Adult Corrections. Great job by the Lincolnton Police Department and the NC Highway Patrol.

Congratulations to ADA Sally Kirby-Turner on her conviction of Mario Wilson. A Cleveland County jury recently found him guilty of 2 counts of First Degree Murder, 1 count each of Attempted First Degree Murder, Attempted Robbery with a Dangerous Weapon and Conspiracy to commit Robbery with a Dangerous Weapon. The Court sentenced Wilson to life without parole. Thanks to the Shelby Police Department for a great investigation.

A Lincoln County jury recently found Robert Cranford guilty of 2 counts of Disseminating Obscenities and the Court sentenced him to a suspended sentence of 4-14 months. Congrats the ADA Lydia Hoza.

Jesus Moreno recently pleaded guilty to 2 counts of Indecent Liberties with a Child, midway through his trial. The Court sentenced him to an active term of 11-23 months in the NC Dept of Adult Corrections. Great job by ADA Lydia Hoza.

After admitting to his Habitual Felon status, the Court sentenced him to an active sentence of 76-104 months in the NC Dept of Adult Corrections.

A Lincoln County jury recently found Tammy Jo Hernandez guilty of Trafficking Methamphetamine. The Court sentenced her to an active term of 70-93 months in the NC Dept of Adult Corrections. Congratulations to ADA Kyle Smith.

Congratulations to ADA Nikki Robinson on her conviction of William Logan. A Cleveland County jury recently found him guilty of Possession of a Firearm by a Convicted Felon and being a Habitual Felon. The Court sentenced him to an active term of 83-112 months in the NC Dept of Adult Corrections. Good job by the Shelby Police Department.

Congratulations to ADA Brittany Padgett on her conviction of Terry McConneaughey. A Cleveland County jury recently found him guilty of Possession With Intent to Sell and Deliver Heroin and Sale and Delivery of Heroin. The Court sentenced him to an active term of 19-32 months in the NC Dept of Adult Corrections, followed by 11-23 months, which was suspended for 36 months, during which time he will be on supervised probation.

Congratulations to ADA Kyle Smith on his conviction of Terry Moore. A Lincoln County jury recently found him guilty of Attempted First Degree Murder, Discharging a Weapon into Occupied Property, Possession of a Firearm by a Felon and a number of other felonies, including multiple counts of Attempted Robbery with a Dangerous Weapon. The Court sentenced Moore to an active term of 941-1,203 months in the NC Dept of Adult Corrections. Great job by the Lincoln County Sheriff's Office.

After empanelling a jury and starting with evidence, the defendant changed his plea to guilty to 3 counts of Manufacturing Methamphetamine, Conspiracy to Manufacture, Possession of Precursor Chemicals and Conspiracy to Possess Precursor Chemicals. The Court sentenced the defendant to an active term of 115-150 months in the NC Dept of Adult Corrections. Thanks to the Cleveland County Sheriff's Office for a great investigation.

The Court sentenced him to an active term of 89-119 months in the NC Dept of Adult Corrections. Thanks to the Lincolnton Police Department for their investigation in this matter.

After admitting his status as an Habitual Felon, the Court sentenced him to an active term of 60-84 months in the NC Dept of Adult Corrections. Thanks to the Lincoln County Sheriff's Office for their investigative work.

A Lincoln County jury recently found him guilty of Trafficking in Methamphetamine and Possession of a Firearm by a Convicted Felon. The Court sentenced him to an active term of 85-120 months in the NC Dept of Adult Corrections. He was further ordered to pay a $50,000 fine. Great job by the Lincoln County Sheriff's Office.

Earlier this week, John Paul Knox pleaded guilty to Attempted First Degree Murder and Assault with a Deadly Weapon with Intent to Kill Inflicting Serious Injury, in Cleveland County Superior Court. He was sentenced to an active term of 220-289 months in the NC Dept of Adult Corrections.

Kelly Sarvis recently pleaded guilty to Second Degree Murder, Robbery with a Dangerous Weapon, Larceny and Obtaining Property by False Pretenses, in Cleveland County superior court. He was sentenced to an active term of 420-547 months in the NC Dept of Adult Corrections.

A Cleveland County jury found him guilty of Assault with a Deadly Weapon Inflicting Serious Injury and Discharging a Weapon into Occupied Vehicle. The Court sentenced him to an active term of 25-42 months in the NC Dept of Adult Corrections. Great job by the Shelby Police Department.

After selecting a Lincoln County jury for trial, Gaither changed his plea to guilty to felony Flee to Elude Arrest, Driving While Impaired and being an Habitual Felon. The Court sentenced him to an active term of 100-132 months in the NC Dept of Adult Corrections.

Congratulations to ADA Will Wiseman on his recent conviction of Demetrius L. Allen. After rejecting a non-habitual felon plea offer from the State, the defendant was tried in front of a Cleveland County jury. They found him guilty of Breaking Entering Motor Vehicle and being an Habitual Felon. The Court sentenced him to an active term of 26-44 months in the NC Dept of Adult Corrections. Great job by the Shelby Police Department.

I HAVE BEEN TRYING TO GET justice FOR MY CHILDREN SINCE 1995 IN 2004 MY ex wife FILLED CHARGE'S OF ASSAUGHT ON A FEMALE charge's AGAINST ME AND THE assistant DISTRICT ATTOURNEY WOULD NOT LISTEN TO ANYTHING I SAID ABOUT WHY SHE WAS DOING THIS I HAD visitation ON THE DAY SET UP BY THE COURTS AND SHE WANTED TO CHANGE THE judge's ORDER BY FILLING FALSE CHARGES ON ME SO I COULD NOT SEE THEM I TRIED IN 2004 AFTER THE I WAS FOUND NOT GUILTY BUT SHE WOULD NOT PERSUE CHARGES OF perjury AGAINST HER EVEN THOGH THEY WHERE FELONIES. I HAVE LATER FOUND OUT THAT I THINK IT IS BECAUSE OF THE department OF social SERVICES. I HAVE BEEN TRYING ALL THE WAY UP TO 2019 AND THEY CONSIDER IT TO OLD EVEN THOUGH I TRIED IN 2004 WHEN THE CASE WAS FILLED. due TO MY ex WIFE GETTING THE CHILDREN THEIR LIVES HAS BEEN RUINED AND ONE OF HER CHILDREN EVEN COMMITED SUICIDE IN THE JAIL AT CLEVELAND COUNTY BECAUSE HE NEVER HAD A CHANCE NEVER WEND TO SCHOOL AFTER JUST A FEW YEARS . he HAD NO TOOLS ALL BECAUSE SHE TRIED TO LABEL HIM DISABLED BECAUSE OF DISLEXIA my ATTORNEY AT THE TIME EVEN WOULD NOT HELP ME EVEN THOUGH HE TOLD ME THAT THE FALSE CHARGES HAPPENS EVERYDAY I TOLD HIM I NOW KNOW WHY THERE IS NOT JUSTICE FOR THE MEN IN Cleveland COUNTY DSS CASES. the DEPARTMENT OF DSS get funding from the Government for children of these woman that choose not to work so it turns out to be a financial gain to the Department of Social Services. Nobody is willing to stop it, As you are learning with the Department of Social services under Citizens for Good Government their has been some Problems there. I feel it is much bigger that this.
