There have been a lot of questions regarding culverts recently. Trustee Shotsberger asked that this information be shared.
Sec. 6-2-3. - Culverts, driveways, and drainways; drainage easements.
A.
For the purposes of this section, the term "exterior property" shall mean any open space on the premises and on any adjoining property under the control of, enjoyed by, or used by the owner(s) of such premises, outside of any structures thereon, including, but not limited to, any tree bank, parkway and/or swale or drainway thereon (whether or not otherwise included within a right-of-way, parkway, or easement).
B.
The property owner in the village shall be responsible at all times to maintain the exterior property of the premises, including any swale, drainage easement, drainway, right-of-way, parkway, driveway, and entrance culvert and flares on or adjacent thereto, by regular maintenance; and by clearing any obstruction and/or by cleaning or repairing any entrance culvert as necessary to maintain the free flow of surface water and stormwater for drainage purposes.
