The American Family possesses a fundamental liberty interest in the care, custody and control of the child and/or children. This right is protected by the concept of substantive due process made applicable to the States by the 14th Amendment. The Court’s have decided that this right of control and privacy is a core value that is ultimately essential for the preservation and maintenance of ordered

liberty in a representative democracy. This core doctrine leads the court’s to mouth the standard that if the State intrudes upon the sanicity of the family they must do so in the least intrusive manner possible. While this sounds good as a public policy, the sensiter and subtle philosophy and overriding concern for the child’s welfare tarnishes the application of this doctrine. The child foster care system as now judicially administered attempts to impose upon the individual choice of the parent a State supported concept of correct child rearing techniques and methods. This, of course, leads to the official arrogance of power that the Bill of Rights was specificially designed to limit.

GREAT NEWS out of Florida! A mom in Tampa filed a pro-se appeal (Petition for Writ of Certiorari) with the 2nd DCA, challenging the trial court's order denying her motion to lift the no contact order against her sons and sua sponte ordering that they be evaluated for their ability to protect themselves.

Today, in a strongly worded opinion, and the FIRST written opinion in a DCF case this year, the Court granted the mother's petition and quashed the trial court's order.
