FOUR-YEAR PRISON SENTENCE FOR DOMESTIC STRANGULATION

Joshua Aguirre agreed to a sentence of four years of imprisonment in the Illinois Department of Corrections in exchange for a guilty plea to the offense of aggravated battery-strangulation, Class 3 felony, and domestic battery.
DeKalb County Judge Joseph Petersen accepted the plea.
DeKalb County Assistant State’s Attorney Brooks Locke stated during the plea hearing that the morning of July 22, 2021, Aguirre was a passenger in a car being driven by the victim in the 800 block of Lucas Street, DeKalb. The two, who were in a dating relationship, began to argue. Aguirre struck the victim in the face with the back of his hand, cutting her nose and causing it to bleed. Aguirre then threw the victim’s wallet out the car window. The victim stopped the car and the argument continued on the sidewalk. Aguirre threw a lighter at the victim, striking her in the head and cutting her scalp. At the time of the incident, there was a protective order filed by the victim against Aguirre. Aguirre was charged with misdemeanor domestic battery and violating the order in the incident.

Four days later, at about 3 a.m. July 26, while free on bond, Aguirre was at the victim’s DeKalb home when the two began to argue. Aguirre slapped the victim in the face and then held his arm around her neck, strangling her and restricting her breathing. He bit the victim on the body, punched her in the face, kicked her in the ribs. The victim fled the apartment, Aguirre followed and punched her in the face again before attempting to flee when he saw police.
DeKalb County State’s Attorney Rick Amato said:
“This defendant is going to prison because he was so focused on his control of the victim that no court order or condition of his release would stop his fixation. He violated a court order when he battered the victim the first time, and he still was not deterred. When he strangled her two days later after seeing a judge and getting out of jail, he identified himself as one who is capable of murder. An offender who strangles their intimate partner is 750 times more likely to kill that person. My thanks to the DeKalb Police Department for the investigation, and to ASA Locke for his work in this prosecution.”
Joshua A. Aguirre, age 35 (d.o.b. 2-16-1987), of the 4000 block of North Drive, Pueblo, Colo. Case Nos. 21CF336 and 21CF340.

DeKALB WOMAN PLEADS GUILTY FOR STEALING $140K FROM LABOR UNION

Kandis M. Talley has agreed to a sentence of 4 years of probation and 180 days in jail in exchange for a guilty plea to theft, Class 1 felony. In addition, Talley must pay $90,000 in restitution.
DeKalb County Judge Marcy Buick accepted the plea.
DeKalb County Assistant State’s Attorney Suzi Collins stated during the plea hearing that for approximately 20 years, until June 2016, Talley served as treasurer of the the DeKalb Federation of School Assistants Union. During that time she stole more than $140,000 from the union by writing herself checks from the union’s account or by writing checks to “cash.” Accounting inconsistencies were discovered in 2016 after the union elected a new board. When confronted by police, Talley admitted she stole the money.
The union’s insurance carrier provided $50,000, making the restitution amount $90,000.
DeKalb County State’s Attorney Rick Amato said:
“People often refer to financial crimes such as this one as ‘victimless crimes.’ That’s just not true. In this case, while Ms. Talley was this union’s treasurer, not only did she betray their trust, members were told that they could not file grievances because of a lack of funds. In fact, the funds would have been available had this defendant not stolen them. Financial crimes cause great harm to victims, often forcing businesses to close or families too declare bankruptcy. My thanks to the DeKalb Police Department for the investigation and to ASA Collins, the Criminal Division chief, for her excellent work in holding this defendant accountable and ensuring that the union is made whole.”

Kandis M. Talley: Age 64 (d.o.b. 11-19-1957), of the 8100 block of Rich Road, DeKalb, Illinois. Case No. 17CF517

Wesolowski on Oct. 26, 2021, pleaded guilty to the offense of aggravated DUI, Class 2 felony, in the death of 43-year-old Michael Jackson, who had just moved back to Illinois from Florida.
DeKalb County Assistant State’s Attorney Scott Schwertley stated in court that the night of Jan. 6, 2020, Wesolowski was driving a vehicle north on Somonauk Road near Pratt Road. The vehicle left the road to the right and struck a tree. Jackson, who was riding in the front passenger seat, was ejected from the vehicle and died as a result of his injuries. According to Illinois law, Wesolowski must serve at least 85 percent of the sentence. He receives credit for two days served in the DeKalb County jail.
DeKalb County State’s Attorney Rick Amato said:
“Unfortunately, despite hundreds of fatal drunken driving crashes every year, too many people still believe they can drive while impaired. In this case, Mr. Wesolowski’s poor choices left a man dead and a family grieving, and he’ll have several years to sit in prison and think about it. I hope this resolution provides a sense of justice to Mr. Jackson’s family. My thanks to ASA Schwertley for his work in this case, and to the DeKalb County Sheriff’s Office for its work in the investigation.”
Dylan A. Wesolowski: Age 28 (d.o.b. 7-12-1993), of the 700 block of Oxbow Avenue, Oswego, Illinois. Case No. 20CF18.

ILLINOIS APPELLATE COURT REJECTS APPEAL OF CONVICTION FOR 2018 DOMESTIC ATTACK

An Illinois appellate court has upheld a 2019 conviction for domestic offenses against a man who strangled a DeKalb woman with whom he was living.
In affirming Ricky Golden’s conviction for the felony offense of aggravated domestic battery and misdemeanor domestic battery, as well as the sentence of eight years of imprisonment in the Illinois Department of Corrections, the Illinois Appellate Court Second District praised the detailed and meticulous work of the DeKalb County State’s Attorney’s Office during the prosecution.
DeKalb County prosecutors in January 2018 charged Golden after a violent altercation with his girlfriend, the survivor. Golden grabbed the survivor by the neck, impeding her ability to breathe, and kicked her. Golden at the time was free on bond in three pending 2017 misdemeanor domestic battery cases involving the same survivor.
In June 2019 after a bench trial, DeKalb County Judge William Brady found Golden guilty on all counts. Judge Brady then retired, and Judge Mary L. Buick presided over the sentencing, which took place in October 2019.
Golden appealed the conviction and the sentence, claiming, among several things, that the court allowed inadmissible evidence at trial, that the evidence was insufficient for a finding of guilty because the survivor was not present at the trial, and that his right to a speedy trial was violated.
As the case was pending, prosecutors made note to the judge of the numerous occasions that Golden unlawfully contacted the survivor and told her to recant her story, lie about the attack, or to not cooperate with prosecutors. The appellate court cited this pattern of conduct in agreeing that the evidence was properly admitted.
In rejecting the claim that the evidence was inadmissible, the appellate court noted that prosecutors worked to have the survivor present at the trial, and that Judge Brady had stated he believed the survivor’s absence from the trial was the result of Golden’s efforts.
The appellate court found that photographs of the survivor’s injuries were consistent with statements she made to police immediately after Golden attacked her, and therefore the evidence was sufficient to convict.
DeKalb County State’s Attorney Rick Amato said:
“I appreciate that the appellate court cited the work of Assistant State’s Attorney Ali Friend in rejecting Mr. Golden’s appeal.
“Domestic violence and abuse does not stop for a victim just because the victim was able to seek some initial help by calling the police. Many abusers put a lot of effort into controlling the daily behavior of their victims including to get the victim to either change their mind about prosecuting or talk the victim into not showing up for trial. As an advocate for survivors of domestic violence and for crime victims, I’m pleased that Mr. Golden's work proved fruitless.”
