For nearly 100 years, Fuel True: Independent Energy and Convenience has been representing the independent energy-marketing industry in Kansas. Today’s Fuel True members include fuel/energy distributors, gasoline retailers and convenience store operators. And all our members select from a

range of programs and services designed specifically to help them in the day-to-day operations of their business. Among the member business materials, programs, and services we offer, you’ll find:

• Fuel True-organized education programs and networking opportunities keeping members in the know and connected to other segments of the industry.

• Fuel True's lobby representation in the Kansas Legislature, seeking to obtain Fuel True-provided regulatory guidance keeping members informed on state and federal compliance issues. Fuel True-offered insurance and credit-card-processing programs.

• Daily business consumables, including decals and custom invoices, that are affordable and often not available elsewhere.

• Tank Management Services, Inc. (TMS), a wholly-owned subsidiary of PMCA, provides valuable environmental-data services to tank owners, such as electronic data interchange, statistical inventory reconciliation.

• TMS also provides third-party liability insurance for underground storage tanks and sponsors EPA-required training programs for persons engaged in the use of underground storage tanks. In addition to Fuel True’s distributors and retail members are active associate members representing nearly 100 companies whose products and services are vital to the success of petroleum distributorships, convenience stores, and retail outlets.

ACT NOW ON CREDIT CARD COMPETITION ACT!

It’s officially go time - Senators Marshall and Durbin have filed the Credit Card Competition Act as an amendment to the GENIUS Act. The GENIUS Act is the cryptocurrency bill that will be coming to a vote within days. Our CCCA bill will be germane as an amendment to a bill that is important to the president and Republican majorities, so it is time to strike!

Now is the time to flood Senate offices with phone calls and emails. We’ve heard the banks are “freaking out” and “out in full force.” We are sending an industry-wide call to action today and need your help activating your members. Can you ask your members to help in these 3 ways:

Recruit your industry friends to take action.

Ask your friends, neighbors, and colleagues to help. Flood their offices with input from everyone. The banks have all the money, so we need all of the grassroots! Have their phones ring off the hook!

I’m a constituent reaching out to ask the Senator to vote YES on the Marshall-Durbin Amendment to lower credit card fees.

The passage of this bill is a major priority for my business.

Swipe fees are my 2nd highest operating cost, an ever-increasing expense that only multiplies with inflation.

In fact, the credit card companies take more of my money with every dollar of higher inflation and with every dollar of tariffs. Their huge fees hurt me and drive up costs for my customers.

This bill is a market-based solution to the issue. It doesn’t set the fees but is purely about competition and fostering an environment for market forces to work.

Governor Laura Kelly today issued a state of disaster emergency proclamation, noting that “areas within Kansas and surrounding states are experiencing a fuel shortage, causing long lines at fuel terminals, thereby causing a disruption in supply delivery and a need for drivers to increase the number of hours of service to deliver product.”

In response, the Kansas Corporation Commission has issued a 14-day waiver of 49 CFR 395.3 and 395.5, as adopted by K.A.R. 82-4-3a, to carriers transporting fuel in Kansas. The order is effective from April 30, 2025 through May 13, 2025.

Several unfortunate circumstances have aligned to produce unparalleled challenges with fuel supply. Stress testing on the pipeline, the conversion to summer blends, downtime at refineries due to maintenance, and increased demand due to agricultural planting and warmer weather for drivers have all coincided to produce a tempest across our region. These conditions led to Fuel True requesting the waiver on behalf of our fuel distributor members in western Kansas.

All other applicable state and federal regulations shall apply to include but not limited to: the Controlled Substances and Alcohol Use and Testing; the Kansas Motor Vehicle Driver’s License Act, the federal minimum levels of Financial Responsibility (insurance requirements), and the regulations governing transportation of hazardous materials in Kansas.

For the 33rd consecutive year, Fuel True: Independent Energy and Convenience, previously known as Petroleum Marketers and Convenience Store Association of Kansas (PMCA), graciously donated gasoline to the Kansas Highway Patrol to fuel patrol cars during the holidays. Through the Holiday Highways Safety Program, Fuel True donated vouchers for nearly 525 gallons of fuel for troopers to use as they patrol the highways as the New Year holiday approaches.
