Oregon Freedom Amendment Challenges Draft Ballot Title for Failure to Accurately Describe Constitutional Amendment

The Ballot Title Must Be Revised.

“The people of Oregon deserve a ballot title that tells them clearly what they are voting on,” said Kari Goodheart, Chief Petitioner of the Oregon Freedom Amendment.

“The Attorney General's draft uses different lists in the yes and no statements, leaves protected activities out of the yes statement, understates the constitutional rights created by the amendment, and then tells voters that its effect is unclear. That does not provide voters with the clear and consistent information Oregon law requires.”

Goodheart has submitted her objections during the statutory comment period, preserving her right to seek Supreme Court review if the ballot title is certified without adequately addressing these objections. Her written comments expressly preserve those arguments for potential review under ORS 250.085.

The Oregon Freedom Amendment is asking for a ballot title that accurately describes the amendment—not one that leaves Oregon voters to determine for themselves what a “yes” vote actually means.

Colorado wasn’t taking the chance, why should Oregon? Let’s put this initiative on the 2028 ballot and vote to make it a right to hunt and fish, rather than a privilege… let’s protect our way of life!

Colorado voters will officially have the chance to put the right to hunt and fish in their state constitution.

Initiative 302 collected enough valid signatures to qualify for the November 3 ballot. If approved, it would make hunting and fishing constitutionally protected rights and recognize them as preferred methods of managing wildlife populations. The amendment would still allow the state to regulate hunting and fishing for science-based conservation, public safety and the protection of future opportunities. Because it would amend the Colorado Constitution, it needs 55 percent of the vote to pass.

This comes just two years after Colorado voters rejected a proposed ban on mountain lion hunting. That campaign proved how quickly well-funded anti-hunting groups can use the ballot box to take wildlife decisions away from biologists and turn them into popularity contests.

According to the Colorado Secretary of State, Initiative 302 is now officially on the ballot as Amendment 84. Colorado could become the 25th state to constitutionally protect the right to hunt and fish.

An initiative seeking to add constitutional protections for hunting, fishing, farming and other activities in Oregon has cleared an initial procedural hurdle in its effort to reach the November 2028 ballot: https://bit.ly/4wPFk0g

The proposed constitutional amendment would protect the rights of Oregonians to hunt, fish, farm, trap, ranch, grow food, practice what supporters call "diligent animal husbandry" and participate in wildlife management.

It follows a different petition that failed to qualify for the ballot that sought to significantly expand Oregon's animal cruelty laws, effectively banning hunting, fishing and pest control in the state.
