“The Valpo Chamber Board of Directors has voted to support the Journeyman Distillery Project as an outstanding economic catalyst for Valparaiso, Indiana” stated Rex Richards, President of the Valpo Chamber.

Richards stated this project does several important things for this community. It brings an extremely successful dining destination. The Journeyman Distillery operating in Three Oaks, Michigan attracts thousands of people to their facility. It can and likely will do the same if not more for Valparaiso. Journeyman Distillery will repurpose a large, worn out industrial building that has been vacant for years into a destination tourism attraction. The Journeyman Distillery Project will extend the downtown south of the railroad tracks and be a catalyst for increasing the demand for residential living in Downtown Valparaiso. In addition, the Journeyman Distillery Project is located in Valparaiso’s Opportunity Zone and will encourage additional development in that area.

Richards thanked the City’s Redevelopment Commission for their foresight in acquiring the former Anco building and developing a plan to attract projects like the Journeyman Distillery Project to Valparaiso.

“The Valpo Chamber sent letters of thanks to State Senator Ed Charbonneau and Representative Ed Soliday for their support of the passage of Senate Enrolled Act 1. This bill was passed by both Houses of the Indiana General Assembly and signed by Governor Holcomb on Thursday, February 18. This new law provides businesses with protection against COVID-related lawsuits,” stated Lee Lane, Vice Chair of Public Policy for the Valpo Chamber. Rex Richards, Valpo Chamber President, co-signed the letter.

Lane further stated, “This piece of legislation was at the top of the Valpo Chamber’s list of initiatives and we are so appreciative of the efforts that our legislators made to quickly pass this law, which provides business owners with peace of mind. It takes away concerns of frivolous lawsuits and allows the business community to focus on recovery.”

U.S. Chamber Offers Pandemic Relief Small Business Update Call TODAY at 2:00 p.m. EST

Please join U.S. Chamber executive vice president and chief policy officer Neil Bradley and CO— content director Jeanette Mulvey TODAY, December 22, 2020 at 2:00 p.m. ET for a Small Business Update to hear the latest about what the pandemic relief bill could mean for the small business community. Click here to register now and please feel free to encourage your small business members to attend this briefing as well.

ICEA received inquiries on Monday about the inclusion of 501(c)(6) organizations with questions specific to eligibility. Thank you to the U.S. Chamber for the following details:

Summary of 501(c)(6) Eligibility in Pandemic Relief Package Expansion of PPP

The final pandemic relief package restarts the Paycheck Protection Program (PPP) and expands PPP eligibility to include 501(c)(6)s. The language begins on page 2102 (in the PDF) and can be found here. The authority to make new PPP loans will terminate on March 31, 2021. 501(c)(6) organizations are eligible to receive a PPP loan provided:

1. They are not a professional sports league or organized for the purpose of promoting or participating in a political campaign (Note: this will not impact chambers of commerce or trade associations);
2. They do not employ more than 300 employees;
3. They do not receive more than 15% of their receipts from lobbying activities;
4. Lobbying activities do not compromise more than 15% of the organization’s total activities; and
5. The cost of the lobbying activities of the organization did not exceed $1,000,000 during the most recent tax year that ended prior to February 15, 2020.

If an organization fails any of these tests they are NOT eligible to receive a PPP loan.

Similar rules apply to Destination Marketing Organizations.

Lobbying activities are not defined in the section. The Small Business Administration may provide a definition or guidance. Congressional staff have used information available in the 990 tax form when discussing the impact of the 15% lobbying activities limitation. Specifically, staff have compared the lobbying expenses reported on schedule C, Part III-B, Line 2 with the total expenses reported for the year (Page 1, line 18). (Note that these lines may be different if you are using a 990 form vs. 990EZ.)

Absent further guidance, organizations may wish to analyze their most recent 990 to determine whether they may be eligible to apply for a PPP loan and may wish to proceed with their lender if they believe they do qualify.

The bill also expands allowable uses for PPP funds and simplifies the loan process.
