NARAL Admits Pro-Lifers Are Succeeding at Online Messaging | National Review

"In Arizona and Michigan, NARAL found that focus-group participants often used pro-life language when discussing New York’s 2019 Reproductive Health Act, which explicitly legalized abortion for all nine months of pregnancy — for any reason up to 24 weeks’ gestation and with broad exceptions after that point. The article also points out that NARAL’s own research has found that Internet users are likely to find pro-life content on Facebook and YouTube.

This is another helpful sign that the pro-life movement is successfully using the Internet and social-media platforms to bypass the mainstream media, which tend to favor the abortion-rights argument. Websites such as LifeNews, LifeSiteNews, and Live Action provide timely analysis and commentary from a pro-life perspective.

In 2020, Students for Life of America launched a YouTube series called “#Why,” a project in which I’ve participated and which provides hard-hitting pro-life perspectives on a range of life issues. Live Action has its own video series entitled “Pro-Life Replies” which provides pro-life responses to common arguments from supporters of legal abortion."

Abraham Lincoln, as a lawyer, made this point in 1857 about the infamous Dred Scott v. Sandford:

"If this important decision had been made by a unanimous concurrence of the judges, and without any apparent partisan bias, and in accordance with legal public expectation, and with the steady practice of the departments throughout our history, and had been in no part based on assumed historical facts which are not really true...it then might be, perhaps would be, factious...to not acquiesce in it as a precedent. But when...we find it wanting in all these claims to the public confidence...it is not even disrespectful to treat it as not having...established a settled doctrine for the country."

When has Roe ever been settled? After two original dissenting opinions, numerous constitutional amendments to overturn the decision were debated in Congress between 1973 and 1983. Judicial and scholarly criticism of it continues to this day. Half or more of the states constantly test the limits of Roe, sparking test cases in the courts every few years. Today, there are more than 40 cases on abortion in the lower federal courts. Roe created a constitutional crisis that has never died but only moved from one forum to another.

Roe is unsettled because of its inherent defects. It was poorly put together with no evidentiary record, based on hunches, assumptions and prejudices.

To protect the rule of law, the Court can do nothing better than to overturn Roe and return the abortion issue to the states, where public policy and public opinion can be better aligned.

In a way that only he can, Ernest Hemingway uses a literary device known as the Iceberg Theory to tell stories that lead readers to personal, emotional conclusions. In the short story "Hills Like White Elephants," Hemingway alludes to abortion without ever saying the word or even mentioning a baby. In this story, you’ll hear a man and woman talking over beer and liquor at a bar in Spain while they wait for a train. The emotional space between them is tense. Another character is present—a character whose life is on the line.

AUL Argues It's Time to Stop The Killing In Brief to Supreme Court to Overturn Roe - Americans United for Life

Americans United for Life filed a friend of the Court brief in the U.S. Supreme Court today, In Dobbs v. Jackson Women’s Health urging the Justices to overturn Roe v. Wade. Clarke Forsythe, Senior Counsel at Americans United for Life and principal author of the AUL brief, made the following statement:

"There is an urban legend that Roe and Casey are settled. Politics aside, as a matter of law, our nation’s abortion decisions are radically unsettled.

Widespread opposition, judicial and scholarly criticism, and a divided court reveal the shaky foundation of the cases that formulated the supposed right to abortion.

Roe should be overturned because it is confusing and unworkable in the lower courts, and this compromises the dependability of American law. There are overt disagreements among Justices about the presence of a right to abortion in the Constitution, meaning the rattled state of Roe is bigger than politics. There is no right to abortion in the Constitution, and it is time the Court acknowledged that evident reality."

Anti-abortion movement eyes its holy grail

“We never know exactly how the justices will rule,” Foster said. “We do know that the justices, a majority of them, claim to be committed constitutionalists, textualists, originalists and that they will look to the text of the U.S. Constitution. We know that the constitution does not protect the right to destroy human life in the womb. And it does not prohibit states from protecting our fundamental right to life. And so we're looking forward to the debate in the court. We expect that it's going to be free and frank."

Anti-abortion advocates are hoping that their holy grail could finally be within reach, cheering Mississippi's new push to get the Supreme Court to overturn the 48-year-old Roe v. Wade decision.

Mississippi Urges Supreme Court To Overturn Roe v. Wade

Mississippi’s Attorney General Lynn Fitch called on the Supreme Court Thursday to defend the right of states to pass laws protecting “life and women’s health,” urging the court to overturn the landmark abortion case Roe v. Wade.

The attorney general filed a brief in Dobbs v. Jackson Women’s Health Organization, which the court will hear beginning in October, slamming Roe as “egregiously wrong” and calling on the Supreme Court to uphold Mississippi’s ban on abortions after 15 weeks.

Dobbs will be the first major abortion case in which all three of former President Donald Trump’s Supreme Court justice appointees participate, including Justice Amy Coney Barrett, who gained a seat on the court after a contentious confirmation process in October.

At issue is the question of whether all pre-viability bans on abortions are unconstitutional.

State Attorney General Makes The Case to Overturn Roe v. Wade to the Supreme Court - Americans United for Life

Americans United for Life applauds the State of Mississippi and its Attorney General, Lynn Fitch, for making the case for the overturn of Roe v. Wade loud and clear to the Supreme Court. The States and the People should decide the controversial and highly politicized question of abortion, not a majority of nine unelected Justices on the Supreme Court. It is time for the Court to finally give up its de facto role as the National Abortion Control Board.

The legal fallacy of Roe and its progeny is clear. The millions of precious lives lost based on the false premise of a constitutional right to abortion is undeniable. Now is the time for Roe to join Dred Scott v. Sanford in the dustbin of history where it belongs.

The United States Constitution does not protect the right to destroy human life in the womb, and it does not prohibit states from protecting our fundamental right to life. We look forward to a free and frank debate in the Court and in American law and culture over how we can best care for mothers and children while respecting every person’s constitutional rights.

Steven Aden, chief legal officer at Americans United for Life, declined to predict how Gorsuch might approach Dobbs. But Aden, whose group has fought for abortion restrictions for nearly five decades, noted Gorsuch has embraced his reputation as a textualist, the notion that jurists decide cases based primarily on the text of the law.

That, Aden argued, ought to auger well for the anti-abortion cause.
"Any judge who is a fan of an original, textual reading of the constitutional text – who's loyal to the intention of those who wrote it – is a friend of the right to life," Aden said. "He's also been one of the strongest federal judges on religious liberty, going back to the 10th Circuit."

The 'Women's Protection Act': A Massive Misnomer

When it comes to this bill, you can't take a name at face value. We must read between the lines and stand up against threatening redefinitions of women, health, and protection. A child is not a problematic medical condition. Mothers are capable and deserving of the whole truth, health provisions must be clear and thorough because lives are on the line, and protections are for every American— including those who could be thrown away as unwanted, inconvenient, or disabled. The “Women’s Health Protection Act” is a deceiving misnomer and its extreme reforms normalize standards that are strikingly dangerous for Americans.
