In an increasingly interconnected regulatory landscape, agencies frequently share regulatory responsibilities. Although overlapping responsibilities can create challenges for agencies, regulated parties, and the public, clear and effective written agreements can help agencies address such challenges and facilitate coordination.

A new recommendation from ACUS identifies best practices to help agencies:

- Develop agreements and manage their implementation.
- Make important agreements available to the public.
- Clarify roles and responsibilities.
- Promote accountability.
- Strencthen collaboration.

Federal agencies regularly communicate during rulemaking—sharing information, experience, and expertise; providing feedback on draft and proposed rules; and coordinating related regulatory actions.

A new recommendation from ACUS identifies best practices to help agencies:

- Proactively seek input from other agencies.
- Consider feedback received from other agencies.
- Determine when to include interagency communications in the public rulemaking docket or administrative record for judicial review.
- Develop internal policies that guide agency personnel on whether, when, and how to communicate with other agencies in rulemaking.
