Supreme Court Update: Court Hears Oral Arguments in Austin v. Reagan - Scenic America

On Nov. 10, the Supreme Court of the United States heard oral arguments in City of Austin v. Reagan National Advertising. Justices expressed concerns about the sweeping implications of the case on the national landscape, raising questions about highway safety, the legacy of the Highway Beautification Act, and the potential costs of overturning longstanding scenic laws. However, they also questioned whether or not the ban on off-premise digital signs is content-neutral, and how First Amendment scrutiny could apply to different messages. We are heading to Idaho for more Native American culture for this week's #BywaysFriday. The Northwest Scenic Byway is an All-American Road that travels 202 miles through Idaho and Montana. Breathtaking views of rivers and mountains parallel the trail that Lewis and Clark once took, where they met members of the Nez Perce Tribe, a group that has lived in the area for more than 11,000 years.

In honor of #VeteransDay, we honor and thank all of those, past and present, who serve and protect our country. Throughout the country there are hundreds of national and state scenic byways that traverse battlegrounds and towns important to the Revolutionary War, the War of 1812, the Civil War, and other military landmarks. For example, the Great Lake Seaway Trail goes through New York and Pennsylvania showcasing historic landmarks from the War of 1812.

In honor of #NativeAmericanHeritageMonth, today's #BywaysFridays feature is the Native American National Scenic Byway, which traverses 350 miles through North and South Dakota. Every stop along the way highlights Native American culture. Stop in Yankton, South Dakota, to see artifacts and learn about the region's rich history at the Dakota Territorial Museum. The byway offers the stunning view of a 50-foot-tall statue of a Native woman who honors the cultures of the Lakota and Dakota people; nearby is the Akta Lakota Museum and cultural center teach more about the history and current ways of these tribes. One of the most moving stops along this byway is the final resting spot of Sitting Bull. A seven-ton bust situated on a bluff of the Missouri River honors the great Sioux leader.

HAPPY HALLOWEEN! Whether you prefer ghosts and ghouls, or jack o' lanterns and candy, America's Scenic Byways have a place for you.

Essex Coastal Scenic Byway in Massachusetts starts in Lynn and goes 90 miles to Salisbury; one of the 14 coastal towns it goes through is Salem. Famous for their witch trials, the town goes all out decorating for the beloved holiday. The town is featured in many Halloween movies like Adam Sandler's Hubie Halloween and Disney's Hocus Pocus.
Another Scenic Byway offering spooky vibes is the White Pole Road in Iowa. Nearby you can spend the night in the Villisca Axe Murder House in Villisca Iowa. It is said that ghosts still remain in this home from a crime that was never solved. This 26 mile byway offers the historical context of train robberies and the wagon times, all you must do is follow the white painted poles.

We are going up north, while the geese are flying south for this week’s #BywaysFridays. Check out the North Shore Scenic Drive in Minnesota. Demand Restitution for Tree Cutting

Here's a horror story just in time for Halloween. In South Providence, Lamar Advertising clear-cut 109 mature highway buffer trees to improve the visibility of one of its billboards. More than just scenic assets, these trees provided residents of neighboring communities from pollution, run off, and noise. And what's more: Lamar is slated to go before the ordinance committee on Nov. 3 to seek a change in the signage code to digitize its billboards. Providence residents, tell your city officials that you want restitution for the destroyed trees, that Lamar should remove this billboard, and that the city ordinance committee should NOT change the code to suit Lamar's interests. Join us on Wed, July 28th for our 3pm Rally and Press Conference at the Thomas Auditorium at the Blue Ridge Community College for the Preservation of the Crab Creek Community. The rally is our one and only chance to send a message to the County officials who will decide the fate of our community by deciding whether to approve and allow a developer to build 125k sq ft storage facility at 547 Crab Creek Road. Such a mega monstrosity will destroy our rural character, devalue nearby property, threaten our clean water and compromise public safety. Your presence at the Rally makes a difference as it will show that we as a community are united in our plea to Henderson County officials for more responsible and managed planning. We will have expert witnesses plead our case from various fields that will testify as to the negative impact such a storage facility will have in our rural community and how it will interfere with the beautiful environment that both locals and millions of tourists enjoy every year. The County decision is extremely important to the future of our community and neighboring counties because once the County allows commercial businesses to build on rural and residential zones, it will be almost impossible to reverse that decision which then potentially allows for other commercial enterprises to follow suit. We hope to relate the message to the County that with proper planning the county is capable of protecting and enhancing the rural and small town character of Crab Creek while also allowing for growth. There are currently 53 storage facilities within 20 miles of the proposed storage site, 37 storage facilities within 15 miles and 13 within 10 miles. Henderson City Council just approved a project allowing the building of a new 99k sq ft storage facility off Asheville Highway. Great news in the battle against billboard blight! A second Montreal borough has just announced plans to ban and remove all billboards from its territory. Within a little over a year, the four advertising billboards pictured here, along with 53 others across Rosemont-La-Petite-Patrie borough, will have to be taken down. The move comes after Montreal's Plateau-Mont-Royal borough established helpful jurisprudence after the advertising industry challenged its billboard ban as unconstitutional, and lost. That case went all the way to the Supreme Court of Canada.
