West Palm Beach Police Department Social Media Terms of Use

Welcome to the official social media pages, profiles, and accounts of the West Palm Beach Police Department (hereinafter “Department Page” or “Department Pages”). References in this Terms of Use (“TOU”) to the “West Palm Beach Police Department” or “Department” include all divisions, units, and personnel of the West Palm Beach Police Dep

artment, as well as authorized designees, contractors, and agents who manage Department Pages. These Terms of Use apply to all Department Pages operated by or on behalf of the West Palm Beach Police Department. The Department intends each Department Page to serve as a limited public forum for the purpose of sharing information and engaging with the community.

1. Acceptance of Terms of Use

The West Palm Beach Police Department provides Department Pages as an informational service (“Service”) to users (“users” or “parties”), subject to the following Terms of Use. Use of any Department Page is voluntary. If you do not agree to the terms contained in this TOU, you should not use Department Pages. By accessing or using a Department Page, you acknowledge and agree to these Terms of Use. The Department may update these Terms of Use at any time without prior notice. It is your responsibility to review this TOU periodically. Continued use of Department Pages after changes are posted constitutes acceptance of those changes. Users are also subject to the Terms of Service (TOS) of each third-party social media platform (such as Facebook, Instagram, X, or other platforms) on which Department Pages operate.

2. Platform Privacy Policies

When you access social media platforms where the West Palm Beach Police Department maintains Department Pages, you are also subject to the privacy policies and Terms of Service of those platforms. The Department does not control the privacy practices or policies of third-party social media platforms. Any personal information you provide while using a platform is collected and managed by that platform according to its policies. When you visit a platform, you may provide two types of information:

Personal information you voluntarily disclose to the platform

Information collected automatically by the platform based on your use of the platform

The West Palm Beach Police Department does not control how social media platforms collect or use this information and generally does not store user data beyond what may already be retained by the platform. For purposes of this TOU, “Content” includes any information, communications, comments, messages, links, images, photos, videos, or other material. When posting Content to Department Pages, you are posting on a third-party platform and do so at your own risk. While platforms may offer privacy settings, no system is completely secure. The Department cannot guarantee that Content posted to Department Pages will remain private or inaccessible to unauthorized persons.

3. Account Security

Users are responsible for maintaining the confidentiality of their own account credentials on any social media platform. The West Palm Beach Police Department is not responsible for any loss or damage arising from activities conducted under a user’s social media account.

4. User Conduct

Users are responsible for the Content they post on Department Pages. The West Palm Beach Police Department does not control user-generated Content and does not guarantee the accuracy, integrity, or quality of any such Content. By using Department Pages, you acknowledge that you may encounter Content that may be considered offensive, objectionable, or inaccurate. Users agree not to post or transmit Content that:

Is unlawful, threatening, abusive, harassing, defamatory, obscene, or discriminatory

Encourages violence or criminal activity

Harms or exploits minors

Impersonates any person or entity

Contains confidential, proprietary, or legally protected information

Infringes upon copyrights, trademarks, or other intellectual property rights

Contains unsolicited advertising, spam, or promotional materials

Includes malware, viruses, or harmful code

Disrupts discussion or interferes with other users’ ability to participate

Violates any local, state, or federal law

Harasses, stalks, or threatens others

Collects personal information about other users without permission

The West Palm Beach Police Department does not remove content solely because of a user’s viewpoint. However, the Department reserves the right to remove or moderate Content that violates these Terms of Use or is inconsistent with the purpose of the Department Page. The Department may also preserve or disclose Content when required by law or when reasonably necessary to:

Comply with legal obligations

Enforce these Terms of Use

Protect the rights or safety of the Department, its personnel, or the public

Address potential criminal activity

If a user posts Content containing threats or depictions of violence, the Department may refer that information to appropriate law enforcement authorities.

5. Compliance With Laws

Users agree to comply with all applicable local, state, and federal laws when using Department Pages.

6. User License to the Department

By posting Content on a Department Page, you grant the West Palm Beach Police Department a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, display, and distribute that Content in connection with Department communications or public information efforts. This license applies unless the Content is otherwise protected by law or owned by another party.

7. Indemnification

Users agree to indemnify and hold harmless the West Palm Beach Police Department, the City of West Palm Beach, and their employees, officers, and agents from any claims arising from:

Content posted by the user

The user’s use of a Department Page

Violation of these Terms of Use

Violation of any applicable law or the rights of another party

8. No Commercial Use

Department Pages are intended for informational and community engagement purposes. Users agree not to reproduce, duplicate, sell, or exploit any portion of a Department Page for commercial purposes without authorization.

9. Content Retention and Use

The West Palm Beach Police Department may establish guidelines regarding the retention or deletion of Content on Department Pages and may modify those guidelines at any time. The Department is not responsible for any loss of Content posted to a Department Page.

10. Modifications to Department Pages

The West Palm Beach Police Department reserves the right to modify, suspend, or discontinue any Department Page or its features at any time. The Department will not be liable for any such modification, suspension, or discontinuation.

11. Termination of Access

The West Palm Beach Police Department may restrict or block users who repeatedly violate these Terms of Use. Access will not be restricted solely based on viewpoint, but may be limited for violations of these rules or disruptive behavior.

12. Links to External Sites

Department Pages may contain links to third-party websites or resources. The West Palm Beach Police Department does not control or endorse external sites and is not responsible for their content, policies, or practices. Users access those sites at their own risk.

13. Language

These Terms of Use are written in English. Content posted in languages other than English may be subject to moderation if it cannot be reasonably reviewed by Department staff.

14. Updates

The West Palm Beach Police Department reserves the right to revise these Terms of Use at any time. Updates will be posted publicly, and users are encouraged to review them periodically. Definitions
