Federal Judge Sides with Massachusetts Voters and Consumers, Dismissing All Counts Against 2020 Right to Repair Law

BOSTON – Four years after Massachusetts voters overwhelming approved the first-in-the-nation Right to Repair law, attempts by car manufacturers to prevent it from ever taking effect have finally come to end.

Judge Denise J. Casper today dismissed all charges in the automobile industry’s federal lawsuit, their latest attempt to block the will of Massachusetts voters and consumers.

“Today is a big win for both consumers and local independent repair shops alike,” said Tommy Hickey, Executive Director of the Right to Repair Coalition. “The judge has dismissed all counts in this erroneous suit by the car manufacturers to block a law that Massachusetts voters overwhelmingly supported more than four years ago.

Today’s ruling comes at a crucial time for thousands of drivers with 2022 cars – which are now coming out of warranty. The law requires auto manufacturers begin sharing wireless repair data with car owners beginning with the 2022 model year. Without it, owners of these vehicles will be prevented from taking them to the local repair shop they choose.
“I applaud today’s decision by federal Judge Denise Casper to dismiss the lawsuit that the automobile manufacturers filed to block Right to Repair in Massachusetts,” said Attorney Edward Colbert, counsel for the Massachusetts Right to Repair Ballot Committee. “This lawsuit was intended solely as another delay tactic and the Attorney General demonstrably proved, and the Court correctly found, that the Massachusetts Right to Repair Law clearly does not conflict with any federal law including the Motor Vehicle Safety Act or the Clean Air Act, and it should be enforced immediately.”
“We would like to thank Attorney General Andrea Campbell and her team for their tireless work on this case and thank the judge for her swift action to preserve the right to repair law,” continued Hickey. “Car owners can now be the gatekeepers of their own repair information and choose where to get their cars repaired. They will no longer be at the mercy of car manufacturers, who time and time again have chosen profits over consumer choice.”

We had a great round table conversation with Elizabeth Warren regarding Right to Repair laws keeping up with technology. Great to see our leaders at the federal level supporting small business and consumer choice!

Auto shops push for ruling in 'Right to Repair' lawsuit. It's been 18 months since MA voters approved an update to the Right to Repair law:

BOSTON — More than 18 months after Massachusetts voters soundly approved an update to the state’s “right to repair” law, the changes have yet to go into effect.

“Question 1 on ‘right to repair’ won majority in every city and town in Massachusetts” and “The campaign to expand access to vehicular data, known as the “right to repair” coalition, won big in the 2020 election…”

Boston had the largest number of “yes” votes from the sheer size of the city’s population.

We are about to make history, but we need your help today.

Only once before in Massachusetts history has a ballot initiative passed while being outspent by the opposition. We can change this together.

The big automakers are trying to defeat YES on 1 for Right to Repair by spending millions of dollars in the hope of securing a monopoly over car repair. They out spent us 2 to 1, but we know with your vote we will win.

We are a coalition of 4,000 independent auto repair shops who know what is at stake. If YES on 1 for Right to Repair does not pass, our independent car repair shops will be forced out of business by not having the ability to repair cars. And to make matters worse, you will lose the choice in where to repair your car, and will be forced to the dealerships.

This is what is at stake today.

Help us make history by defeating the big automakers and voting YES on 1!

The big automakers are using fear mongering tactics to tell your personal and location data stored by your vehicle can be used by criminals.

Why are they collecting this data? Why are they spending millions to ensure they have exclusive access?

The big automakers are trying to scare you into giving them a monopoly.

They’ve spent millions of dollars on telling you your data will not be secure unless only their dealerships have access to wireless diagnostic repair information.

Your data isn’t at risk.

Your freedom to choose where to repair your car is.

The big automakers are spending millions of dollars to tell you that your personal data can be stolen if your local mechanics have access to your car’s wireless repair information.

Who do you trust more? Your trusted mechanic or big automakers who want exclusive access to your data?

Massachusetts Right to Repair is a coalition of 4,000 Massachusetts independent auto repair shops, local auto part stores, consumers and drivers interested in making sure consumers have access to all of the repair and diagnostic information on the vehicle they own.

We believe that it's your car and you should decide how and where to get it serviced.

You should own your car's repair data, not the big automakers.
