The Cape High Court found in favour of the Western Cape Provincial Government at a 2nd interdict attempted to force construction to stop until a cheaper, less invasive solution be found was held on Mon 28 May 2012, at the Cape High Court, Keerom Street, Cape Town. The DA Provincial Government and Entilini are not following correct procedure to build on Chapman's Peak and will not explain why cheaper less invasive electronic tolling can not be used. Helen Zille has stated she will not bow to protest for fear of setting a a precedent for protesting ! Chapman’s Peak drive, (Cape Town), in all her natural mountainous lush surroundings, gives ‘heart stopping' pleasure, to all that have the opportunity to share, in her raw natural beauty. Due to occasional falling rocks on the road that provides the opportunity to appreciate the cliffs, the view and access to hikes, as well as linking the villages of Hout Bay and Noordhoek, a contract for a tolling system was introduced several years ago to pay for its upkeep to reduce accidents. The toll company now wants to build a massive and excessive toll plaza to replace the existing small booths and at the same time they thought they would build themselves a two story office block nearby. This will cost R54 million - over R30Million of which to be paid by taxpayers and only a portion by the toll company who will then own the building for 30 years RENT FREE! This building will permanently mark this otherwise natural area and is completely unnecessary. Entilini Concessionair currently rent 90m2 office space for R10 000 per month. Several groups have arisen to try and stop this desecration and have appealed to government to intervene. The DA government has decided to side with the toll company and is supporting the building. Over 8000 signatures, a hunger striker and 2 protesters handcuffed to the construction site for 6 days have not made them stop and reconsider – which does imply a hidden agenda since many cheaper solutions are available for tolling this road.
