The third phase of the JSC 2021- 2025 strategic plan validation process is underway in Nyanga with support from UNDP Zimbabwe, with JSC Commissioners scrutinizing the document.

Chief Justice Luke Malaba emphasised the role of the commissioners in the validation of the Strategic plan- “Commissioners are the custodians of the Strategic Plan and in the whole process,they should be mindful of the constitutional mandate bestowed upon them so as to promote judicial independence and accountability at the end of the day”

The strategic plan is one of the tools used by the commission in implementing judicial accountability independence, efficiency and effectiveness.

It is against this background that commissioners have been urged to embark on scientific management to ensure full implementation of the JSC vision and mission to ensure world class justice prevails in Zimbabwe.

Our respectful view is that ZWLA’s criticism of the JSC for nominations done by the public is misplaced because the JSC does not make any nominations but manages the nomination process.

As ZWLA you are aware that the Judges’ appointment process is done in terms of section 180 of the Constitution. The nomination of candidates to be considered for appointment is done by the public and the President. The responsibility of the JSC is to call for nominations. This obligation was duly complied with when the call was made from 31 May 2020 and remained valid until 30 June 2020.

During the nomination period, we expected the public, including organisations like ZWLA, to nominate persons to be considered for appointment. At the close of the nomination period, we received twelve valid nominations composed of ten male and two female candidates.

Following concerns raised by litigants and legal practitioners on the availability and publication of judgments that would have been read in court, the Chief Justice, after consulting and engaging with Judges, issued the Memorandum below.

The Memorandum is meant to guide Courts and Judges on the need to pronounce judgments only when they are ready, and to avail judgments to the public immediately after such pronouncement.
