21 February 2020.

NCA Statement on the violence at the Heal Zimbabwe
public meeting.
•The NCA party would like to register its gratitude for the
efforts made by Heal Zimbabwe Trust, Crisis in Zimbabwe
Coalition and Election Resource Centre to jointly organize
a public meeting on 20th February 2020 at Crown Plaza
Hotel in Harare to discuss about the gazzeted
Constitutional Amendment Bill 2/2020.
•The NCA party supports the endeavor to open and
promote dialogue between citizens. It is with deep regret
and dismay however that the NCA party proceeds to
make the following observations from the public meeting;
•A meeting that was meant for the benefit of the public
was disrupted by members and supporters of the MDC
Alliance with the encouragement and in the presence of
its senior leadership who included Hon Vincent
Tsvangirai, Hon Kucaca Pulu, Hon Happymore Chidziva,
Councillor Jacob Mafume and Councilor Denford Ngadziore
•Hon Priscilla Misihairambwi Mushonga from MDC-T
invited to share her views by the organisers was shouted
down, verbally abused with unprintable words, threatened
and mocked by MDC Alliance members and supporters in
shocking scenes that clearly demonstrates a culture of
intolerance,violence against women as well as gross
disrespect for the same.
•The NCA President who was invited as a speaker at the
public meeting was continuously interjected by rowdy
members of the MDC Alliance inspite his invitation as a
Constitutional expert to explore the gazzeted
Constitutional Amendment Bill 2/2020.
•People living with disability who attended the public
meeting were thrown across the room as MDC Alliance
members scrambled and attempted to sn**ch away the
microphone from panelists who they blamed for sharing
diverse views.
•These scenes of chaos, intolerance and violence in which
political leaders control rented crowds have no place in a
civic space. Public meetings and events organized by civil
society to further a culture of debate should not be
undermined by organized thuggery, sponsored
hooliganism and other forms of intimidation against
persons perceived to hold alternative views.
•Democracy will never thrive alongside barbarism. The NCA
party makes no distinction between violence by opposition
parties and violence by state actors. The NCA party holds
that it is hypocritical to purport to fight for freedom of
expression whist using physical means and violence to
attack persons who hold divergent views.
•NCA party condemns the supplying of intoxicants to
young people in order to abuse them through busing them
to disrupt and attack public engagement forums meant
to promote citizen participation in national processes
which have a direct bearing to policy formulation and
development.
•The NCA party remains committed to exhausting all
avenues of dialogue in search of lasting solutions to
revive our country from poverty and despair to a nation
where citizens can enjoy stable and predictable
livelihoods.
•As NCA party we continue to encourage civil society to be
steadfast in arranging any form of meetings that
promote debate amongst our citizens.
•We urge MDC Alliance and other similar militant
organisations to accept that difference of opinion is a
celebrated component and ingredient of a healthy
democracy.

*Polad rejects constitutional amendment*

POLITICAL parties affiliated to President Emmerson Mnangagwa’s Political Actors Dialogue (Polad) yesterday rejected the proposed constitutional amendments, saying it was “too premature for the government to publish a Constitutional Amendment Bill.”
Constitutional law expert and Polad member Lovemore Madhuku said a special subcommittee tasked to analyse the Bill had observed that most of its provisions were unacceptable.
“We have taken a two-stage approach and we are calling on the government to withdraw the Constitutional Bill in Parliament and this is what we are going to be recommending to our plenary,” said Madhuku, who heads the opposition National Constitutional Assembly (NCA).
“We are saying it is too premature for the government to publish a Constitutional Amendment Bill. As Polad we have to discuss what are our electoral challenges, political challenges, and constitutional challenges ahead of 2023 election on the reforms that we wish to have undertaken.”
“The question is why are you rushing for the removal of the running mate when the elections are in 2023. As Polad we also really want the electoral laws amended in a number of areas to create a free and fair election,” said Madhuku.
“What we did is we went into that Bill clause by clause and some things would be acceptable while some are not acceptable. We looked if there were good ideas in the Bill and on balance we found that most of the things are not acceptable and we completely rejected the Bill.”
“Even if the government decides to go ahead with the amendment, we will fight on the provisions relating to the Judiciary, it’s a unanimous position again. Judges must retire at 70 mandatory and as a subcommittee we have said judges must retire at 70.”
Madhuku said on matters relating to gender equality in Parliament they had reached an agreement of 50/50.
“The point that must be clear is that the Polad subcommittee has not endorsed the Constitutional Amendment Bill. We are not going to accept the Constitutional Amendment Bill and that we can assure you,” he said.

Mwonzora’s article on Tsvangirai misleading.

The opinion piece in the Newsday of Friday August 21 2015, written by MDC-T Secretary General Douglas Mwonzora seeks to change history of the struggle against Mugabe’s regime. The article is distorted and full of praise and worship of the person of Morgan Tsvangirai. While I see no problem with supporting political leaders of one‘s choice it is still necessary to do so using correct facts.

Firstly in his misleading article Douglas Mwonzora attributes “The NO VOTE” victory in 2000 Referendum to Morgan Tsvangirai and his MDC. This is not only false but a clear deliberate attempt to lie to Zimbabweans. It is historically and correctly captured that the “No Vote” campaign was led by civic society under the banner of NCA. The chairperson of NCA then was Ms. Thoko Matshe. It is clearly evident that at this time the MDC was still at its initial stage of formation and it had no structures countrywide except for the interim committee.

It is myopic to take Mwonzora’s false assertion that his leader Tsvangirai is the sole victim of the ZANU PF regime. Citing Tsvangirai as the sole victim of Highfields beatings is not only surprising but a mere rhetoric coming from a spectator of that event. The unfortunate Highfields event was organized by Civic society under the banner of Save Zimbabwe Campaign. An activist Gift Tandare was killed by the police in Highfields. The people who were brutally assaulted included Civic Society leaders, political parties and church leaders. Those who were seriously injured included Morgan Tsvangirai, Grace Kwinji , Prof Lovemore Madhuku , Sekai Holland to mention but a few. Those arrested and detained for days also included Arthur Mutambara ,Job Sikhala ,Gladys Hlatshwayo, Alois Dzvairo, Rashid Mahiya, Sydney Chisi, Madock Chivasa and Nelson Chamisa.

It is surprising how some ZANU PF traits are surfacing in the article by Mwonzora. He argues that “Tsvangirai’s strongholds were denied full opportunity to register as voters.” Before the MDC T , ZANU PF is the only political party that claimed to own people in Zimbabwe . It is therefore weird for Douglas Mwonzora to start fronting an opinion that there are certain sections of Zimbabwe that belongs to his dear leader Morgan Tsvangirai. I believe that Zimbabweans vote for political leaders expecting an improvement in their lives and it is not true therefore to conclude that there is anyone who can own Zimbabweans regardless of the situation at hand.

Maybe Mwonzora’s misleading piece is because he is a stranger to the politics of MDC and its history. He is trying to narrate the events which he read and not witnessed. As late as 2005, Mwonzora was one of the few Zimbabweans who still believed that Abel Muzorewa could be the president of Zimbabwe. Douglas Mwonzora was a top “national” executive member and apologist of Abel Muzorewa under the banner of the treacherous United Parties.

It is therefore clear that the success that Mwonzora is trying to bestow upon his current leader is a result of a collective effort by all stakeholders who were not happy with the ZANU PF regime. I still believe that after Tsvangirai was deserted by his allies in 2013 he became weak and dismally lost the general election. The kind of arrogance and attempts to alter history in Mwonzora’s article is a clear testimony that the MDC T party is heading to a sad ending and is being led by people who don’t even know its history. This is quite unfortunate!

NCA Statement on the planned dismissal of Harare City Council Workers.
•The NCA party is alarmed and angry to hear reports that the MDC-T dominated Harare City council intend to dismiss more than 3000 workers.
•As NCA party it’s our hope that the media reports on the intended dismissal of council workers is not true. If it is true we call upon the responsible authorities to stop it. If it is true we condemn the MDC-T unreservedly.
•How can an opposition party that still want to be regarded as labour backed even contemplate such a move when the whole country is focusing its efforts on reversing the effects of the dismissal of 20 000 workers?
•Only last night MDC-T MPs in parliament were mourning the dismissal of 20 000 workers during the debate on the labour amendment bill. This is worse than hypocrisy if it is true that the MDC-T dominated Harare city council is planning to dismiss 3000 workers.
•NCA party is calling upon the Harare city council to explore other ways of cutting costs such as reducing the huge salaries and allowances being paid to the top well known corrupt management.
•It is unacceptable for any employer to use the dismissal of workers as the first option to deal with any challenges.
•If the media reports on the planned dismissal of council workers are not true then we call upon the MDC-T to instruct its councilors to behave responsibly.

The National Constitutional Assembly (NCA) says it is “alarmed and angered” by reports that the MDC-T dominated Harare City Council intends to fire more than 3000 workers following last months Supreme Court ruling that employers only needed to give three months notice to terminate contracts.

It is unacceptable for any employer to use the dismissal of workers as the first option to deal with any challenges.”

Meanwhile the MDC Harare Province has issued a statement declaring that wishes it will not allow the MDC-dominated council to fire “even a single employee in line with the recent Supreme Court ruling. The party, through the province, has since directed the council not to engage in the needless retrenchment of employees in compliance with the court ruling.”

Eric Murai, the Provincial Chairperson said “It is the MDC, a pro-workers party, that deployed these councillors to serve all ratepayers in the first place and we will not allow them to be complicit in the Zanu PF ploy to fight and fire workers on notice in an arbitrary and insensitive manner, without any packages or benefits.

“In any case, it is individual councillors as chairpersons of council committees that had purportedly resolved to fire the 3 000 workers. Certainly, the decision of a few individual councillors cannot be allowed to prevail on a momentous issue of such magnitude in the absence of the convening of a full council,” Murai added.

Zuva, ex-managers legal battle far from over
THE legal fight between Zuva Petroleum and two of its managers is far from over amid reports that the employees, Don Nyamande and Kingston Donga, have not given up.

Constitutional law expert Lovemore Madhuku, who is leading a team of lawyers representing the two, confirmed the matter was still pending at the Constitutional Court (ConCourt) and would now be heard like any other case.
“There has been a misinterpretation in the media that the case is closed and over. That is wrong because Justice Vernanda Ziyambi was asked by the Chief Justice Godfrey Chidyausiku to rule on whether the case should be heard as an urgent matter or not.
“In her ruling on this, she passed comments on the quality of the appeal but those comments will not have a bearing on the outcome. It is still going to be heard and it is true that it might not be proper for our clients to make comments regarding this issue at this point,” said Madhuku.
Legal sources interested in the matter claimed that Nyamande and Donga still had pending cases against Zuva at the High Court as well as the Labour Court. Madhuku, however, said he was not aware of these.
“We are only representing them on this ConCourt application,” he said.
Nyamande seemed to confirm this in a short telephone interview with The Standard on Friday. When asked to comment on how they had been handling the legal defeat, he said: “It will be premature for me to comment because our case is still on-going.”
He could not be pushed into elaborating.
On July 17 Justice Chidyausiku handed down the judgement that gave government institutions, private companies and quasi-State institutions the right to shed off excess workforce through termination letters and without benefits.
In his ruling Justice Chidyausiku said employers had the same rights as employees and could terminate a contract on three months’ notice.
The ruling was followed by never before seen job cuts estimated to have affected about 20 000 workers.
