SDPI Welcomes Interim Stay on Demolition of Buildings of Jauhar University
Government should regulate the buildings under the provisions of the available government order regarding regularisation — Nizamuddin Khan
Lucknow, Uttar Pradesh: Social Democratic Party of India (SDPI), Uttar Pradesh State President Nizamuddin Khan, has welcomed the interim stay imposed by the Moradabad Divisional Commissioner on the demolition order issued by the Rampur District Magistrate concerning the demolition of 38 buildings of Jauhar University in Rampur. He said that, for the time being, the action to demolish the 38 buildings of Jauhar University has been halted, which is a welcome step.
Nizamuddin Khan said that the administration should now take cognisance of the Government Order issued on 18 June 2026 by the Housing and Urban Planning Section-3, Government of Uttar Pradesh, Lucknow, bearing Letter No. 8-3099/223/2022-Housing and Urban Planning Section-3, and take action in accordance with its provisions.
He said that the subject of the said Government Order is “Regarding the regularisation of maps approved by District Panchayats in Development Authority areas.” The Government Order states that, in cases involving maps approved by District Panchayats within Development Authority areas and constructions already carried out on site, notices and demolition orders are being issued under the provisions of the Uttar Pradesh Urban Planning and Development Act, 1973. In such cases, it has been stated that it is necessary to resolve jurisdictional discrepancies arising due to maps approved by District Panchayats in Development Authority areas.
The SDPI State President said that, under the same Government Order, the Development Authorities have been directed, under the powers conferred by sub-section (1) of Section 41 of the Uttar Pradesh Urban Planning and Development Act, 1973, to resolve cases involving maps approved by District Panchayats in Development Authority areas and constructions carried out on the basis of such maps. According to the Government Order, in order to resolve questions being raised regarding the validity of such approved maps, the details of maps approved by District Panchayats are to be provided to the concerned Development Authorities, and cases are to be disposed of on that basis.
Nizamuddin Khan further said that the Government Order provides for the regularisation of constructions in cases involving construction of residential buildings and development in accordance with the applicable building construction and development by-laws, construction in accordance with the by-laws of District Panchayats, and unauthorised construction under the building construction and development by-laws. In addition, it also provides a mechanism for regularisation in cases relating to change of land use upon payment of the prescribed fee.
The SDPI State President said that when the Government of Uttar Pradesh itself has issued a detailed procedure and guidelines for the regularisation of maps approved by District Panchayats and the constructions related to them, the administration should also take action in the case of the 38 buildings of Jauhar University in accordance with the spirit and provisions of the same Government Order.
He demanded that the Uttar Pradesh Government and the administration regularise all 38 buildings of Jauhar University under the procedure prescribed in the Government Order and, instead of proceeding with demolition, ensure a lawful and just solution to the matter.
Nizamuddin Khan said that demolition is not a permanent solution to any problem. Since the provisions of the Government Order provide a route for regularisation, the administration should adopt a positive and just approach and find a permanent solution to the matter. If necessary, the government may also bring a new ordinance for this purpose.
