Update for our families. The 8/1 ammendments have been approved. However, the Live In Caregiver Rate Reduction has been rescinded! Big impacts continue to be Relatives can not provide DHI services, and the 40 hour rule is per relative, per individual, and encompasses all services. Notice of CMS Approval of Waiver Amendments
Indiana Family and Social Services Administration has received approval from the Centers for Medicare & Medicaid Services (CMS) for the agency’s proposed waiver amendments to the following 1915(c) home and community-based services waivers:
• Health and Wellness
• Traumatic Brain Injury
• Indiana PathWays for Aging
• Community Integration and Habilitation
• Family Supports
Additionally, approval has been received for the 1915(b)(4) Waiver for:
• Contracted Case Management
• Indiana PathWays for Aging
Approved waivers have an effective date of August 1, 2026.
FSSA rescinded the previously proposed rate adjustments for certain personal care services involving live-in caregivers. This includes the services of:
• Attendant Care (ATTC)
o Available on the Health & Wellness, PathWays for Aging, and Traumatic Brain Injury waivers
• Participant Assistance and Care (PAC)
o Available on the Family Support Waiver
• Residential Habilitation and Support – Hourly (RHS-Hourly)
o Available on the Community Integration & Habilitation waiver.
The rate adjustments were included in proposed waiver amendments with a planned effective date of August 1, 2026, pending approval from the Centers for Medicare & Medicaid Services. The proposed adjustments were shared in IHCP Bulletin BT202673. These proposed changes have been removed from the waiver amendments and IHCP Bulletin BT202673 has been rescinded. The State will revisit a rate adjustment for certain personal care services involving a live-in caregiver in future waiver amendment cycles.
