Town of Gila Bend Primary Election Update

On July 30, 2026, the Town Council canvassed the results of the July 21, 2026, Primary Election and adopted Resolution No. 26-08. Pursuant to Arizona law, three candidates for Town Council were declared elected based on receiving the highest number of votes and a majority of the votes cast.

The fourth Council seat remains subject to an automatic recount because candidates Athena Guerrero and Jesus A. Rubalcava each received 67 votes, resulting in a tie. Arizona law requires the Town to certify the election results and the facts requiring a recount to the Maricopa County Superior Court, which will oversee the recount process.

Because both candidates received a majority of the votes cast, the recount will determine which candidate is elected to the remaining Council seat. If the recount results in a clear winner, the Town Clerk will issue the Certificate of Election to that candidate. If the recount results remain tied, Arizona law provides a process for determining the winner of the Primary, with five days’ notice provided to the candidates of the time and place for determining the election by lot. Therefore, the remaining seat will be filled through the statutory process, if necessary, following the court’s announcement of the recount results. Since both candidates received a majority of votes cast under state law, there will not be a runoff election.

The Town will provide additional information as it becomes available from the court and Maricopa County election officials. It is estimated to take a week for tabulation and the court announcement of the results and if a determination by lot is necessary, notices will be issued to candidates with the time and place for that selection to occur in mid-August. Following the declaration of a winner, the Town Clerk will issue the Certificate of Election to that candidate. Candidates will not be seated until the beginning of their term later this year.
