⚖️ Myths vs Facts: Employer-Employee Relationship

❌ MYTH #6:

Companies can avoid labor compliance by labeling regular staff as “freelancers” or “independent contractors.”

✅ THE FACT:

The label of a contract does not determine the true nature of the employment relationship.

Under the Four-Fold Test recognized by the Department of Labor and Employment (DOLE) and Philippine courts, the employment relationship may be determined by factors such as:
🔹 Who selected and hired the worker
🔹 Who pays the worker’s wages
🔹 Who has the power to dismiss the worker
🔹 Who controls the worker’s performance of duties—particularly how, when, and where the work is performed.

When the circumstances establish an employer-employee relationship, the worker may be entitled to the rights and benefits provided under Philippine labor laws, regardless of what the contract calls them.

What matters is not the label—it is the actual working relationship.

🇵🇭 HOLIDAY ADVISORY | NATIONAL HEROES DAY

The Parañaque Workers Affairs Office (PWAO) informs the public that our office will be CLOSED on Monday, August 31, 2026, in observance of National Heroes Day, a Regular Holiday nationwide.

💼 PRIVATE SECTOR HOLIDAY PAY RULES

For employees in the private sector covered by the holiday-pay provisions of the Labor Code:

🔹 If the employee does not work:
➡️ The employee shall receive 100% of their daily wage, provided they were present or on paid leave on the workday immediately preceding the holiday.

🔹 If the employee works:
➡️ The employee shall receive 200% of their daily wage for the first 8 hours.

🔹 If the holiday falls on the employee's rest day and they work:
➡️ The employee shall receive an additional 30% of the 200% holiday rate, or 260% of the daily wage for the first 8 hours.

🔹 For work beyond 8 hours:
➡️ Overtime work is subject to an additional 30% of the hourly rate on the holiday/rest-day rate, as applicable.

📌 Reminder: Holiday pay rules may be subject to applicable exemptions and specific employment arrangements.

📂 PWAO ARCHIVES: RESOLVED CASE

👷 Requesting Party: Glass Installer | 11 Years of Service
🏢 Responding Party: Glass Installer Company
📌 Nature of Complaint: Separation Pay and 13th Month Pay
✅ Status: RESOLVED WITH MONEY CLAIMS

📝 THE WORKER'S CONCERN:

The requesting party sought assistance from the Parañaque Workers Affairs Office (PWAO) to clarify and settle his employment concerns with the company.

He expressed his desire to resolve the matter through PWAO, as he could no longer afford to wait for another three months without a project or regular work assignment. He explained that he needed to move forward, find new employment, and provide for his family.

🤝 CONFERENCE WITH THE RESPONDING PARTY:

A representative of the responding party appeared during the conference.

According to the company, employees had been informed through a memorandum about temporary changes in their work arrangements due to a decline in sales and a reduction in clients. Some employees were placed on an on-call arrangement for three months.

The company representative also cited client complaints concerning some employees' work, including incorrect measurements and instances of employees allegedly being asleep during working hours, as factors contributing to the reduction in clients.

The representative agreed to raise the requesting party's separation pay concern with the owner and informed the office that the worker needed to seek new employment due to his family responsibilities.

⚖️ FIRST MEDIATION:

Both parties attended the mediation.

The requesting party was informed of the company's position. The responding party stated that, according to the General Manager, the requesting party could either be rehired or continue working under a regular schedule as an installer.

However, the requesting party explained that he had already started a new job.

The company presented an initial computation of the worker's monetary claims, including:
💰 Separation Pay & 13th Month Pay: ₱174,487.50
💳 SSS Deduction (Loan): ₱42,797.93

The company noted that the computation could still be adjusted after verifying that the requesting party had actually started working with the company in 2015.

The requesting party was also advised to complete his clearance and return company property, including his uniform, ID, and UnionBank ATM card.

Both parties agreed to settle the monetary claims through two tranches.

🤝 SECOND MEDIATION:

Both parties appeared for the second mediation.
The responding party presented the updated computation of the requesting party's monetary claims:

Gross Amount: ₱165,655.92
Less: SSS Salary Loan: ₱26,701.07
Less: SSS Calamity Loan: ₱16,383.78
💰 NET AMOUNT: ₱122,538.07

The responding party issued two checks, each amounting to ₱61,269.03 and ₱61,269.04, scheduled for:
📅 August 2026
📅 September 2026

The requesting party agreed to the final computation and accepted the agreed payment arrangement. He also agreed to sign the Quitclaim, even though the second check had not yet been encashed.

With both parties reaching an agreement, the matter was considered resolved before PWAO.

✅ CASE RESOLVED

Through dialogue, conference, and mediation, both parties were able to reach an agreement regarding the worker's monetary claims.

PWAO remains committed to providing workers and employers with a venue for dialogue, assistance, and fair settlement of labor-related concerns.
