Under a new administrative law judge hearing process that’s scheduled to begin June 29 – for the DEA to determine the merits of a proposed rule to reclassify cannabis as a Schedule III drug under the Controlled Substances Act (CSA) – President Donald Trump’s administration will only entertain testimony from those who oppose the proposed rule.

Derek C. Julius will be the DEA’s chief administrative law judge to oversee the hearing of a proposed rule to reclassify cannabis as a Schedule III drug.

It’s been six weeks since the U.S. Treasury Department and the Internal Revenue Service (IRS) announced plans to issue guidance to state-licensed medical cannabis businesses seeking Section 280E tax relief under a new federal Schedule III listing.

The U.S. representatives sent a letter urging ‘clear, timely guidance’ for state-licensed medical businesses following the DOJ’s rescheduling order.

A pair of medical-only cannabis states and one prohibition state are joining the fight to reverse the Trump administration’s immediate reclassification of medical cannabis to Schedule III.

Nebraska, Indiana and Louisiana filed a petition for review in federal court, arguing that immediately rescheduling medical cannabis violates administrative procedures.

"The operators and investors that perform best are typically the ones using data to anticipate where the market is heading, rather than reacting after margins are already under pressure."

The report combines global pricing data and operator insight to help investors, regulators and suppliers better understand evolving market dynamics.

The Drug Enforcement Administration (DEA) will open a separate Schedule III registration portal for state-licensed medical cannabis cultivators, manufacturers, testing labs and distributors in the “coming weeks.”

This registration process, through the DEA’s Diversion Control Division, opened for state-sanctioned medical cannabis dispensaries on April 29, following Acting Attorney General Todd Blanche’s signed order to “immediately” reclassify medical cannabis in the U.S., pursuant to the United Nations Single Convention on Narcotic Drugs, an international drug treaty.

The application for non-dispensary businesses to handle Schedule III medical cannabis will be available in the coming weeks.

Pesticide use is a critical consideration for cannabis cultivators, not only for crop protection but also because governments closely monitor the environmental impacts of the ma*****na industry. Historically, ma*****na could not be cultivated using federally approved pesticides due to its status as a Schedule I drug. Although the Department of Justice has rescheduled ma*****na that is lawful under state or federal law for medical purposes, the impact and breadth of such rescheduling on pesticide use is still unclear.

In a regulatory environment where federal guidance is absent and state rules vary, will rescheduling provide an industry standard on pesticide use?
