Tennessee's New Drink Spiking Law is Now in Effect
As of July 1, 2026, intentionally spiking someone’s drink, food, or medication to cause involuntary intoxication is a felony in Tennessee.
We’ve received questions from bars, restaurants, and community partners about what this new law means. One of the biggest misconceptions? The law does not require alcohol-serving establishments to purchase or provide drink testing devices. That requirement was removed before the bill became law.
Preventing drink spiking requires a comprehensive approach—including staff training, active bystander intervention, monitoring unattended drinks, and creating a culture of safety.
