Received a Medicaid denial or reduction in services? You’re not alone — and there are options.

Maneuvering Medicaid denials and appeals can be extremely challenging, especially when important services are at stake. For many individuals and families, receiving a denial or reduction in services can feel overwhelming.

Here are a few important things to know:
⚕️Most Community Medicaid denials or reductions in services require an appeal with Aid Continuing within 10 days.
⚕️ Nursing Home Medicaid denials typically allow 60 days to request a fair hearing.
⚕️ Denials may be related to income, assets, a disqualification period, or insufficient approved service hours.

If your decision came from a Managed Long-Term Care (MLTC) agency, the process includes additional steps:
⚕️First, you must request an appeal with the MLTC agency.
⚕️If that appeal is denied, a second appeal must be filed.
⚕️Only after the second denial can you request a State fair hearing.

For Nursing Home Medicaid applicants, fair hearings are conducted before an administrative law judge and may take place in person or via Zoom.

There has been a lot of confusion surrounding the Nursing Home Transition and Diversion (NHTD) Medicaid Waiver Program. While enrollment is currently paused, the program itself has not been eliminated.

Here’s the current status:

📌 The federal Centers for Medicare and Medicaid Services placed a cap on the number of participants allowed in the NHTD program
📌 In response, New York State Department of Health set a maximum of 9,400 participants for each waiver year (2025–2026, 2026–2027, and 2027–2028)
📌 The program has reached its current capacity, so new referrals are temporarily suspended
📌 As spaces become available, referrals will be accepted on a first-come, first-served basis

The Department of Health will continue to monitor availability and notify Regional Resource Development Centers when openings occur.
