Starting January 1, 2027, New Hampshire's House Bill 1308 enacts much stricter penalties for drivers who unlawfully pass a stopped school bus with flashing red lights.

โข Stopping Distance: You must stay at least 25 feet away from the front or rear of the bus.
โข Both Directions: Drivers traveling behind the bus and drivers approaching from the opposite direction must stop.
โข When to Move: You cannot move until the bus starts moving again or the red flashing lights turn off.

First Offense:
โข Classified as a class B misdemeanor.
โข Fine of $300.
โข Mandatory 7-day driver's license suspension.
Second Offense:
โข Classified as a class A misdemeanor.
โข Fine of $750 or more.
โข License revocation of at least 30 days.
Third or Subsequent Offenses:
โข Classified as a class A misdemeanor.
โข Fine of $750 or more.
โข Mandatory minimum sentence of 15 consecutive days in jail.
โข Driver's license revocation for at least one year.
