She is assisting Bet Tzedek’s Small Business Development with litigation by defending two small businesses in ADA Non-Compliance matters. Her tenacious advocacy helps alleviate the pressure on small business owners that have been accused of non-compliance by a specific individual that has filed a high volume of ADA Non-Compliance suits against many businesses throughout Los Angeles County for personal profit. Bet Tzedek was honored to host National Immigration Law Center's gathering of dozens of advocates from across the region working on the implementation of the Department of Homeland Security’s streamlined process for deferred action and immigration protection for workers whose worksites are being investigated for workplace violations.

Undocumented workers are especially vulnerable to workplace abuse and often fear reporting the violations. This process empowers them and gives them protection from deportation.

As we approach this season of giving, we're thrilled to share a remarkable story of transformation and triumph, made possible by supporters like you. Meet Rosalyn and her incredible daughter, Paralympic Champion Breanna, who came to Bet Tzedek when they faced a critical turning point in their lives.

When Breanna, a girl with a bubbly personality, was diagnosed with autism at four years old, it was an era when autism was a relatively new and mystifying diagnosis. At that time, there was a noticeable lack of information, support, and understanding surrounding autism, particularly when it came to girls. Rosalyn, Breanna's dedicated mother, embarked on an unwavering quest for knowledge and resources.

Breanna, an immensely talented young woman, was growing up and, like anyone, desired the independence to make her own decisions. However, due to her trusting nature, she was at risk of receiving advice from individuals who may not have her best interests at heart. Recognizing the need to "maintain some kind of connection,” Rosalyn turned to Bet Tzedek for support. Through the conservatorship they obtained, Breanna's parents gained the legal authority to assist her in making crucial life decisions.

This newfound support led to a remarkable journey. Breanna, while attending college, discovered her extraordinary talent in track and field, securing scholarship offers, including one from Cal State L.A. Breanna, guided by her mother and her coaches, continued her athletic journey by pursuing Paralympic glory. She embarked on an incredible journey, achieving outstanding milestones. In 2016, in Brazil, she clinched a gold medal. She repeated this extraordinary feat in Japan in 2020 and, in a defining moment, broke the Paralympic world record in the 400-meter dash with a time of 55.11 seconds during the 2022 World Championships in Paris.

"In September of this year, Senator Kirsten Gillibrand of New York, joined by Representative Jerrold Nadler, reintroduced a pivotal piece of federal legislation—the Fashioning Accountability and Building Real Institutional Change (FABRIC) Act. Designed to safeguard an estimated 100,000 garment workers nationwide, the FABRIC Act proposes the federal elimination of the piecework system, ensuring that every garment worker receives at least the minimum wage. This would expand protection to all states, including Texas, where many factories still pay workers per operation. The FABRIC Act establishes national liability for wage theft, holding manufacturers, subcontractors, and brands accountable. To prevent businesses from evading consequences by simply rebranding, the legislation mandates that companies register with the Department of Labor. Importantly, if enacted, the FABRIC Act will institute a multimillion-dollar grant program to support the growth of ethical manufacturing jobs."

“Serving undocumented workers, specifically those who have experienced wage theft and threats of retaliatory immigration enforcement, was the reason I decided to go to law school. Bet Tzedek is the only nonprofit in Los Angeles that can give full-scope service for these clients (because it doesn't get LSC funding), so I knew early on that I wanted to get the chance to work on their team. They are a wonderful, passionate group of movement lawyers with deep connections to the community, workers, and worker centers. I love the mentorship I've gotten and the opportunity to help clients make sure that their rights in the workplace are protected.” -Carson McKinney, Bet Tzedek Extern

As an Extern, Carson has been working with Bet Tzedek’s Employment Rights Project, specifically to develop and submit requests for Statements of Interest as part of an exciting new program through the Department of Health Services (DHS). In January 2023, the DHS announced that it would begin granting Deferred Action for undocumented immigrant workers who are victims of or witnesses to labor disputes. This means that workers can get prosecutorial discretion and work permits, along with other benefits, as a way to counteract the chilling effect of threatened or implied retaliatory immigration enforcement. The first step in the process is filing a complaint with a labor agency (federal, state, or local), and then once an investigation is open, getting a Statement of Interest from that agency saying that covered workers' cooperation is essential to enforcement efforts. Requesting these statements requires showing some of the problems in the relevant industry (garment, car wash, day labor, etc.), such as exploitation or wage theft, and giving pertinent facts about the investigation. In his role, Carson has played a major part in creating just and safe work environments for Angelenos. This month, we are focusing on the joy of giving as we approach Giving Tuesday next Tuesday, the 28th — the largest single day of charitable donations globally — and throughout this holiday season. BT wouldn't be able to secure justice for seniors and dependent adults; tenants, homeowners, and unhoused individuals; children and families; trans individuals; and workers, taxpayers, and small business owners without the help of our generous donors and volunteers! We highlight the nonprofit Mayor’s Fund for Los Angeles and Mayor Bass' call for pro bono volunteers (including Bet Tzedek and our new efforts with the "We Are L.A. Pro Bono Program") to keep Angelenos housed. The news digest also provide information on how, starting next year, there will no longer be an asset limit for Medi-Cal eligibility. Bet Tzedek was able to be a part of the "Alzheimer's Disease: A Community Conversation on Public Health, Population Health & Public Policy" event last Saturday, celebrating Former U.S. House Representative Diane Watson on her 90th Birthday. It also honored her for her fierce advocacy, passion, and commitment to establishing and advancing both legislation and policies surrounding healthcare, racial justice, and education.

Bet Tzedek and other legal aid agencies are advocating to expand the waitlist to allow all who are eligible to access the services.

"The California Department of Health Care Services told local agencies in July that it was no longer accepting new applications because the program was hitting its annual cap on participants. 'It was kind of a shock,' said Pauline Shatara, deputy director of California Advocates for Nursing Home Reform.

The state said it was planning to ask the federal government for more slots that would become available in January, though it was still determining how many."

James is on the autism spectrum. As he grew older, his mother, Molly, was worried that people would take advantage of James’ trusting nature, and that without clearly defined support, he might have challenges accessing the tools that he needed to fully thrive as an adult.

And so, ten years ago, Molly and James connected with Bet Tzedek’s Self-Help Conservatorship Clinic, the only service of its kind in Los Angeles, where an experienced Bet Tzedek advocate guided them through every step of the legal process, helping James secure his conservatorship. “We certainly couldn't have done it on our own,” Molly stated.

Over the past ten years, James has been able to access financial resources and protections because of the conservatorship.

Years later, Molly was in a position to make a significant donation, and she came back to Bet Tzedek. “We realize that we are blessed, and we recognize that many others need help. It is from a place of appreciation, gratitude, and gladness we make donations to Bet Tzedek so that others may also benefit from [their work].”
