VGM Government Relations is a major participant in fulfilling the advocacy goals for VGM and its members, and is vital for the future of independent home medical equipment, rehab and O&P providers. The mission of the Government Relations department is to develop and maintain positive relationship with policy makers, community leaders, DME providers, and industry trade associations, and to work wit

h them to promote the DME industry. To accomplish its mission, the Government Relations department works to identify laws, regulations or issues that will directly impact the DME industry; develops and maintains relationships with elected officials in order to develop trust and enhance communications; and develops and maintains relationships with its members and industry trade associations to communicate important information relating to the industry. In 2002, VGM created the position of Vice President – Government Relations and hired John Gallagher to fill this important position. As a veteran of the medical products industry and with experience lobbying for independent businesses in Washington, Gallagher was the perfect fit. Since his hiring, Gallagher has amassed thousands of frequent flier miles traveling back and forth to Washington D.C. He has met with government officials including the United States President, the Senate Finance Committee Chairman, the House Majority and Minority leaders, officials at the Congressional Budget Office and the Centers for Medicare and Medicaid Services, and many more. His discussions with the government officials always make the case for preserving the ability of the independent dealer to survive and thrive in this marketplace, and ensuring access to quality care and equipment to those who require DME equipment. Gallagher is also a frequent speaker at industry trade association meetings across the country where he presents on the current status of the legislative environment, regulatory issues, and the importance of grassroots. He is also a board member of the Healthcare Quality Association for Accreditation (HQAA) and the Fraud Eradication Advisory Team (FEAT).

CMS Makes Finalized Change to DMEPOS Competitive Bidding Program

The Centers for Medicare and Medicaid Services (CMS) has issued the FY 2027 Inpatient Rehabilitation Facilities (IRF) Prospective Payment System (PPS) Final Rule (CMS-1845-F), increasing the DMEPOS Competitive Bidding Program’s bid surety bond amount to $100,000 (previously $50,000).

DMEPOS providers intending to submit a Round 2028 bid are encouraged to review the bid surety requirements on the CBIC website and be on the lookout for an update from CMS regarding the registration and bidding dates.

Kentucky Governor Announces Reprieve from Previously Announced Kentucky Medicaid 4% Rate Cut

On July 22, 2027, Governor Andy Beshear delivered welcome news when he announced that an unexpected state surplus has generated sufficient funding to avoid the planned 4%
Medicaid reimbursement cut scheduled to take effect August 1, 2026. The administration expects the surplus funding to sustain current reimbursement levels through June 2027, the end of the state’s fiscal year. While Kentucky Medicaid providers and beneficiaries have received an immediate reprieve through June 2027, providers were put on notice that the funding solution is temporary and that Medicaid funding will be revisited by the Kentucky General Assembly during its January session to address ongoing budget pressures continuing the uncertainty of reimbursement rates.

The VGM Government Relations team will continue to advocate for rate stability beyond June 2027.

Advocacy Win! H.R. 1703 Passes the House Under Suspension of the Rules

The House has passed the Choices for Increased Mobility Act (H.R. 1703), a major victory for wheelchair users and the CRT community.

HR1703 establishes separate Medicare coding for ultralightweight wheelchairs made with advanced materials like titanium and carbon fiber, helping expand beneficiary choice and access to the mobility technology that best meets individual needs.

This achievement reflects years of advocacy from consumers, providers, clinicians, manufacturers, and industry partners working together to advance access to complex rehab technology.

Next stop: the Senate. While House passage is a significant milestone, continued advocacy will be critical to getting this bill across the finish line.
