WELLSBURG, WV – Brooke County Prosecuting Attorney Allison Adyniec Cowden announces that on May 12, 2025, William Kirk Swager, age 58, pled guilty to the felony offense of “Entry of a Building Other Than a Dwelling.” The statutory penalty for the offense is confinement in a state correctional facility for not less than one (1) nor more than ten (10) years. The Hon. Jason A. Cuomo suspended the defendant’s sentence for three (3) years of supervised probation, during which time the defendant will be required to complete the Brooke County Adult Drug Court Program. As well, the defendant shall be required to make restitution.
On September 16, 2024, Chief Michael Allman of the Wellsburg Police Department was contacted by Brownlee Lumber and Supply regarding the defendant, Kurt Swager, taking $200 from the change box without permission and not returning it. Allman was advised that on September 10, 2024, the defendant took and $8000.00 check and $2000.00 in cash from a customer as payment for a new kitchen. Swager deposited the check but never deposited the cash. The defendant also took $1500.00 in cash from the same customer for a new countertop while acting on behalf of Brownlee Lumber.
On September 10, 2024, the defendant was confronted by the manager of the store about the missing money. The defendant because very upset, apologized, and began to cry.
On September 16, 2024, it was discovered by Brownlee Lumber that an additional $769.00 had been removed from the store over the weekend after the alarm system was disarmed on Sunday, September 15.
On September 24, 2024, the defendant participated in a Mirandized interview at the Wellsburg Police Department. The Defendant admitted to converting the cash deposits from the customers described earlier to his own use and used his position with Brownlee to effectuate that goal. He also admitted to entering Brownlee Lumber on September 15, 2024, and removing cash from the safe, cash register and night deposits.
