Q: I have a mobile soft-serve ice cream trailer and contract with an event promoter to sell items at private events. I do not provide tables or chairs, but the event promoter does. Are any of my products subject to sales tax?

A: Yes. Sales tax applies to all your sales when you sell and serve your food products at a private event where eating facilities are provided (https://cdtfa.ca.gov/industry/restaurant-owners/).

Q: I sell tickets online to sporting events only. Do I need to obtain a seller’s permit?

A: No. Since sales of tickets to sporting events would not be considered sales of tangible personal property, you do not need to obtain a seller’s permit (https://cdtfa.ca.gov/formspubs/pub109/).
