🏠Housing Tip Tuesday🏠

If you’ve received an eviction notice, don’t panic and don’t assume you have to move out immediately.

Under the RTA, your landlord needs a legally valid reason to evict you and must provide you with the proper forms. Here’s some info on the general process tips to help navigate.

1. Landlord Gives You an Eviction Notice

•check the notice carefully-look at the form number (ex.N4,N5,N12 or N13) the reason given given, the termination date, and whether the information appears to be correct.
•Keep paying your rent unless you have specific legal advice telling you otherwise.
•If you don’t agree to leave or don’t void the notice, then:

2. The Landlord Applies to the LTB

•You will receive notice from the LTB of a hearing date. Don’t ignore it-you have the right to participate and present your side.
•Gather evidence (I.e. your rental agreement, payment records, eviction notices, emails/texts with your landlord, photos/videos, any other documents relevant to your situation)

3. The LTB Makes a Decision

•The LTB may decide to dismiss the application, work out a repayment plan, or issue an eviction order.

4. If an Eviction is Ordered

•Your landlord cannot personally remove you or change the locks. They will file with the Sheriff, you will be served a Sheriff’s notice which states the exact date and time the sheriff will come. The sheriff is the only one that can remove you from your home.

**GET HELP**

If you’ve receivedan N4 notice from your landlord, you can apply to the Housing Emergency Fund for financial assistance.

The Hamilton Justice might be able to help with more specific tenants rights and LTB information.

🏠Housing Tip Tuesday🏠

The RTA has rules to protect tenants, here’s what you need to know about rent increases:

•12 Months and 90 Days: Your landlord must give you an official written notice (N1) at least 90 days before the increase starts. Your rent can only be raised once every 12 months.

•Rent Increase Limit: For 2026, the maximum legal rent increase is capped at 2.1%; For 2027, it is 1.9%.

•Above-Guidelines Increases: A landlord can apply to the Landlord and Tenant Board to get official approval for an AGI. This is allowed for major building repairs, property tax hikes, new security services, etc.
**IF YOU HAVE RECEIVED AN AGI LETTER from your landlord, contact us! You can apply to the Housing Emergency Fund for help with an AGI**

•November 15th 2018: Newer units first occupied as a rental property AFTER this date are completely exempt from rent control limits

🏠 Housing Tip Tuesday 🏠

For the first in a short series on knowing your basic rights as a tenant in Ontario and understanding the Residential Tenancies Act (RTA), let’s get into some tips about the Standard Ontario Lease:

•It’s Mostly Mandatory: If you rent a private home, apartment, condo, or basement, your landlord must use the Standard Lease. Exception: You are not protected by the RTA if you share a kitchen or bathroom with the landlord or their immediate family.

•Custom Rules Are Void: Landlords cannot sneak illegal clauses into your contract that go against the RTA. Bans on pets, guest restrictions, mandatory post-dates cheques or e-transfers, or demanding damage deposits are completely illegal and unenforceable.

•Protections Apply Anyways: Even if you didn’t sign the standard form or signed a different contract, you are still fully protected by all your legal RTA rights from day one.
